     The Governments of the member States of the Commonwealth of Independent States, hereinafter referred to as the Parties,

     Considering the provisions of the Agreement on Cooperation of the Member States of the Commonwealth of Independent States in the Field of Emergency Prevention and Response dated October 16, 2015,

     acting within the framework of implementation in the territories of the States - The Strategy of the World Health Organization for the Implementation of International Medical and Sanitary Regulations (2005) and the control of infectious diseases in the implementation of measures to prevent and eliminate emergencies in the field of public health of a sanitary and epidemiological nature caused by manifestations of dangerous infectious diseases or mass non-communicable diseases (poisoning) or the implementation of threats of bioterrorist acts, as well as other public health events, of international importance,

     Guided by the desire to continue and expand cooperation in the field of public health,

     Recognizing the importance of cooperation in the prevention and elimination of sanitary and epidemiological emergencies in the territories of the Member States of the Commonwealth of Independent States, requiring measures for sanitary protection of the territory of the Member State of the Commonwealth of Independent States, including through specialized anti-epidemic brigades,

      proceeding from the mutual interests of protecting the territories of the member States of the Commonwealth of Independent States from the occurrence and possible consequences of sanitary and epidemiological emergencies related to the spread of an emergency situation in the territories of neighboring States and the risk of restrictions on interstate transportation and trade within the Commonwealth of Independent States,  

      have agreed on the following:  

Article 1

      For the purposes of this Agreement, the following terms are used:  

      The States of the Parties are the States parties to this Agreement.;  

      An emergency in the field of public health of a sanitary and epidemiological nature (hereinafter referred to as an emergency) is an extraordinary event caused by dangerous infectious or massive non-communicable diseases (poisoning), requiring coordinated national and/or international response measures for the sanitary protection of the territory.;

      specialized anti-epidemic brigades are mobile formations of the States of the Parties of constant readiness and emergency response, autonomous functioning, using modern diagnostic, information technologies and equipment, having qualified personnel capable of solving tasks for the prevention and elimination of emergency situations.;

      Requesting Party - A Party that requests assistance in preventing and/or eliminating emergency situations;

      Providing Party - The Party providing assistance at the request of the requesting Party;

      competent authority - the authority of the State of the Party responsible, in accordance with national legislation, for carrying out anti-epidemic and preventive measures in the emergency zone and the implementation of this Agreement;  

      equipment - property intended for the prevention and liquidation of an emergency situation, materials, technical and transport facilities, laboratory equipment of a specialized anti-epidemic brigade, personal property of brigade members, communications equipment, medicines and other necessary property;

      consumables - property used in emergency response work (test systems, diagnostic drugs, laboratory plastic, personal protective equipment, disinfectants, fuels and lubricants, etc.);  

      The transit state is the territory of the State of the Party through which the specialized anti-epidemic brigade is moving.

Article 2

     In the event of an emergency situation with the potential for cross-border proliferation or a threat of such occurrence on the territory of the State of one of the Parties, this Party shall inform the competent authorities of the other Parties, as well as the relevant basic organization of the member States of the Commonwealth of Independent States in this field, of the occurrence of the emergency.

     The procedure for transmitting emergency information is determined by the Council for Cooperation in the Field of Healthcare of the Commonwealth of Independent States.

Article 3

     If a State of one of the Parties, in whose territory an emergency situation has arisen, requests assistance from the State of the other Party or the States of the Parties, specialized anti-epidemic brigades of the States of the other Parties may be involved to eliminate the emergency situation.

     Specialized anti-epidemic teams are used in emergency situations.:

     which cannot be eliminated by the forces and means of one member State of the Commonwealth of Independent States, and only at the request of that State;

     having a transboundary spread and requiring coordinated actions to eliminate the consequences of emergency situations, in agreement with the States whose territories are affected by emergency situations.

Article 4

     The parties provide assistance to each other in accordance with their capabilities and on a voluntary basis.

     The conditions for the provision of assistance, the types and amounts of assistance requested, the organizational structure and number of personnel of specialized anti-epidemic brigades, as well as staffing by type of technical equipment are determined on a case-by-case basis by agreement of the requesting and providing Parties.

     The participation of specialized anti-epidemic brigades of the State of one of the Parties in the liquidation of an emergency situation on the territory of the State of the other Party is carried out in accordance with the legislation of the requesting Party, this Agreement and on the basis of concluded bilateral international treaties between the States of the Parties.

Article 5

     The movement of specialized anti-epidemic brigades of one of the Parties to the emergency zone on the territory of the State of the other Party may be carried out by motor vehicles, sea, river, rail or air transport.

     When performing tasks to eliminate an emergency situation on the territory of a State of one of the Parties, specialized anti-epidemic brigades are required to comply with international treaties concluded within the framework of the Commonwealth of Independent States, including bilateral agreements concluded between the member States of the Commonwealth of Independent States, and the national legislation of the requesting Party.

     A specialized anti-epidemic brigade is required to carry out orders and orders from the requesting Party's management authorities in the emergency response area.

Article 6

     The requesting Party, within the framework of the legislation of its state and in accordance with bilateral international treaties, implements the necessary measures for the priority passage of specialized anti-epidemic brigades across the state border, ensures their escort, including protection, when moving to the emergency zone on the territory of the requesting Party's State, and also provides guarantees for the return of equipment and property to the territory of the providing Party, used to prevent and/or eliminate emergencies.

Article 7

     Members of specialized anti-epidemic brigades cross the state border of the requesting Party's State using valid documents granting the right to cross the border and recognized by the requesting Party as such, through checkpoints agreed by the Parties that are open to international traffic. The heads of specialized anti-epidemic brigades must have a copy of the invitation of the requesting Party requesting assistance, a list of brigade members and a copy of the order to send a specialized anti-epidemic brigade to prevent and/or eliminate an emergency situation in the territory of the requesting State.

Article 8

The movement of equipment and consumables across the state (customs) borders of the States of the Parties, including transit through the territories of the States of the Parties, is carried out as a matter of priority at checkpoints agreed upon by the requesting Party/transit State, upon presentation to the customs authority carrying out customs clearance (performing customs operations) and customs control, a list of equipment and supplies certified by the competent authority of the State of the providing Party, with confirmation, that these equipment and supplies are being moved for the purpose of preventing and/or eliminating emergencies and ensuring the vital activity of specialized anti-epidemic brigades.

     Equipment and consumables transported across the state (customs) borders of the States of the Parties, including those transported in transit through the territories of the States of the Parties, are exempt from customs duties, customs duties and taxes in accordance with the legislation of the States of the Parties and international treaties to which the States of the Parties are parties.

     The customs authorities of the State of the requesting Party/transit State carry out customs clearance (perform customs operations) and customs control with respect to equipment and consumables imported (exported) across the customs borders of the State of the requesting Party/transit State, as a matter of priority, in accordance with the legislation of the States of the Parties and international treaties to which the States of the Parties are parties.

     Members of specialized anti-epidemic brigades may import and transport goods for personal use through the territories of the transit States in accordance with the legislation of the States of the Parties.

Article 9

     The Parties, in accordance with their legislation, shall facilitate the unhindered transit through their territories of specialized anti-epidemic brigades, equipment and supplies of the providing Party, following emergency prevention and response to the territory of the requesting State.

Article 10

     The general management of specialized anti-epidemic brigades in the emergency response area is carried out by the competent authority designated by the State of the Party in whose territory the emergency has arisen.

     The use of specialized anti-epidemic teams not for their intended purpose is not allowed.

Article 11

     Specialized anti-epidemic brigades interact with the emergency management authority, the competent authority for conducting anti-epidemic and preventive measures in the emergency zone, participating in headquarters meetings and exchanging operational information, assisting in replenishing supplies and food supplies, and ensuring the protection of their locations.

Article 12

     The costs of paying members of specialized anti-epidemic brigades, paying for insurance of personnel and property of brigades, as well as the costs of transporting specialized anti-epidemic brigades to and from the emergency zone are borne by the providing Party.

     The requesting Party shall bear the costs of providing medical care, including transportation costs related to the illness, injury or death of members of specialized anti-epidemic teams while performing tasks along the way or returning to assist in the prevention and/or elimination of emergency situations.

Article 13

     The issues of providing specialized anti-epidemic brigades when working in the emergency zone and replenishing supplies and food supplies, protecting the location are resolved on the basis of international treaties between the requesting and providing Parties, as well as in accordance with their legislation.

Article 14

     The main areas of work of specialized anti-epidemic brigades when they are deployed in the territories of the member States of the Commonwealth of Independent States are:

     identification of pathogens of infectious diseases (indication and identification) in clinical materials and environmental objects, sanitary and microbiological control of the environment, food and food raw materials;

     participation in anti-epidemic measures to localize and eliminate epidemic foci of dangerous infectious diseases;

     provision of advisory, methodological and practical assistance to territorial bodies and institutions of sanitary and epidemiological profile, medical organizations of the requesting State.

Article 15

     The functioning of specialized anti-epidemic brigades in the territories of the member States of the Commonwealth of Independent States in terms of the technology of epidemiological work, laboratory diagnostics, and anti-epidemic measures is carried out on the basis of international treaties between the requesting and providing Parties, as well as in accordance with their legislation.

Articles 16

     In order to develop regular cooperation in the field of sanitary and epidemiological welfare of the population, prevention and/or elimination of emergency situations, the Parties:

     regulatory and other documents regulating the implementation of measures to ensure the sanitary and epidemiological well-being of the population in emergency situations are exchanged.;

     they cooperate on issues of joint training of specialists of specialized anti-epidemic brigades, conducting exercises;

     Information is exchanged on scientific and research work in the field of ensuring the sanitary and epidemiological well-being of the population in emergency situations.

Article 17

     By agreement of the Parties, amendments may be made to this Agreement, which are an integral part of it, which are formalized by the relevant protocol.

Article 18

     Disputes and disagreements between the Parties arising from the application and/or interpretation of this Agreement are resolved through consultations and negotiations between the Parties concerned.

Article 19

     This Agreement shall enter into force 30 days after the date of receipt by the depositary of the third notification that the Signatories have completed the internal procedures necessary for its entry into force.

     For the Parties that have completed the internal procedures later, this Agreement shall enter into force 30 days after the date of receipt by the depositary of the relevant documents.

Article 20

     After its entry into force, this Agreement is open for accession by any member State of the Commonwealth of Independent States by submitting an instrument of accession to the depositary.

     For the acceding State, this Agreement shall enter into force 30 days after the date of receipt by the depositary of the instrument of accession.

Article 21

     This Agreement is concluded for an indefinite period. Each of the Parties has the right to withdraw from this Agreement by sending a written notification of its intention to the depositary no later than six months before the withdrawal and settling the obligations that have arisen during the validity of this Agreement.

     Done in Astana on October 28, 2022, in one original copy in Russian. The original copy is kept in the Executive Committee of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Agreement.

RESERVATION OF THE REPUBLIC OF AZERBAIJAN to the Agreement dated October 28, 2022 on cooperation of the member States of the Commonwealth of Independent States on prevention and response to emergencies in the field of public health of a sanitary and epidemiological nature

     The Republic of Azerbaijan does not consider itself bound by the provisions of the Agreement on Cooperation between the CIS member States in the Field of Emergency Prevention and Response dated October 16, 2015, as it is not a party to it.

      The provisions of this Agreement will not be applied by the Republic of Azerbaijan to the Republic of Armenia until the consequences of the conflict are completely eliminated and relations between the Republic of Armenia and the Republic of Azerbaijan are normalized.

SPECIAL OPINION OF THE REPUBLIC OF ARMENIA on the Agreement on Cooperation of the Member States of the Commonwealth of Independent States on Prevention and Response to Public Health Emergencies of a Sanitary and epidemiological Nature

     In connection with the submission by the Republic of Azerbaijan of a Special opinion on the Agreement on Cooperation between the Member States of the Commonwealth of Independent States on prevention and response to emergencies in the field of public health of a sanitary and epidemiological Nature, the Armenian side considers it necessary to note the following.

The provisions of this document will be applied by the Republic of Armenia to the Republic of Azerbaijan based on the results of the implementation of all agreements stipulated in the framework of the trilateral statements of the leaders of the Republic of Armenia, the Russian Federation and the Republic of Azerbaijan dated November 9, 2020, January 11 and November 26, 2021, as well as the complete liberation of the occupied territories of the Republic of Armenia by the Republic of Azerbaijan, elimination of the consequences of aggression and the political and diplomatic resolution of the Nagorno-Karabakh conflict in accordance with the norms and principles of international law in the interests of achieving the goals set out in the UN Charter.
