PROTOCOL to the Agreement between the Government of the Republic of Kazakhstan and By the Government of the Russian Federation on cooperation in the field of prevention of industrial accidents, catastrophes, natural disasters and elimination of their consequences dated March 28, 1994 on the simplified procedure for crossing the state border by emergency services and formations

The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, recognizing the importance of timely response to emergencies, including those of a cross-border nature, and proceeding from the need to increase the effectiveness of interaction and coordination of emergency response activities, in order to create an effective mechanism for the implementation of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on Cooperation in the field of prevention of industrial accidents and catastrophes, of natural Disasters and the elimination of their consequences dated March 28, 1994, have concluded this Protocol on the following:
Article 1
The concepts used in this Protocol have the following meanings: "emergency rescue service" is a set of management bodies, forces and means designed to solve tasks of preventing and eliminating emergency situations and functionally integrated into a single system based on emergency rescue formations.; An "emergency rescue unit" is an independent or part of an emergency rescue service structure designed to carry out emergency rescue operations, based on rescue units equipped with special equipment, equipment, equipment, tools and materials, and canine crews.; "emergency situation" is a situation that has arisen on the territory of the state of one Party as a result of an accident, disaster or catastrophe that has caused or may cause death of people, damage to their health, the environment, significant material losses and disruption of the living conditions of the population.; "liquidation of emergency situations" - search and rescue, emergency recovery and other urgent work carried out in case of emergency situations and aimed at saving lives and preserving human health, reducing damage and material losses, as well as localizing emergency zones; "equipment" - materials, technical and transport means, equipment emergency services and formations and the personal equipment of their members.
Article 2
The Parties shall designate the following competent authorities for the implementation of this Protocol: on the Kazakh Side - the Ministry of Emergency Situations of the Republic of Kazakhstan, the Ministry of Defense of the Republic of Kazakhstan, the Ministry of Agriculture of the Republic of Kazakhstan, the Border Service of the National Security Committee of the Republic of Kazakhstan; on the Russian Side - the Ministry of the Russian Federation for Civil Defense, Emergencies and Elimination of Consequences of Natural Disasters, the Federal Security Service of the Russian Federation. In the event of a change in the names of the competent authorities of the States of the Parties or the appointment of other competent authorities, the Parties shall immediately notify each other in writing through diplomatic channels.
Article 3
In order to prevent and eliminate emergency situations in the border territories of the States of the Parties, the competent authorities of the States of the Parties shall ensure that emergency rescue services and formations of the States of the Parties cross the state border at checkpoints and outside existing checkpoints in compliance with the border control procedure established by the legislation of the States of the Parties.
Article 4
1. Border control for members of the emergency services of formations is carried out at checkpoints and outside the existing checkpoints in accordance with the legislation of the States of the Parties and international treaties to which they are parties. 2. Upon receiving a notification of an emergency, the competent authorities of the States of the Parties shall inform the border services of the States of the Parties of the need for emergency services and formations to cross the state border through checkpoints and outside the existing checkpoints. 3. In order to eliminate emergency situations, members of emergency rescue services and formations cross the state border of the State of the Party requesting assistance through checkpoints and outside existing checkpoints, as a matter of priority, simplified crossing of the state border, the border service of the State receiving assistance is provided with a list of members of the emergency rescue service and formations, as well as a list of equipment. 4. Upon receiving information about an emergency situation, the border authorities and air defense forces of the States of the Parties shall take immediate measures to ensure that emergency services and formations cross the state border through checkpoints and outside existing checkpoints, as well as air borders. 5. The movement of emergency services and formations and the transportation of their equipment are carried out by road, rail, water or air transport. The procedure for using these types of transport to provide assistance is determined by the competent authorities in coordination with the State authorities of the Parties. 6. Aircraft are allowed to cross the state border by the competent authorities of the States of the Parties to eliminate emergency situations.
Article 5
This Protocol shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force.
Done in Pavlodar on September 19, 2012 in two copies, each in the Kazakh and Russian languages, both texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Protocol, the Parties shall refer to the text in Russian.
