Decree of the President of the Republic of Kazakhstan dated December 11, 2007 No. 489
I DECREE:
1. To approve the attached draft Protocol on Amendments to the Technical Annex on Customs Procedures and Document Processing to the Main Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8, 1998.
2. To authorize Serik Nygmetuly Akhmetov, Minister of Transport and Communications of the Republic of Kazakhstan, to sign on behalf of the Republic of Kazakhstan a Protocol on Amendments to the Technical Annex on Customs Procedures and Document Processing to the Main Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8, 1998, with the right to make amendments and additions to it that are not fundamental character.
3. This Decree shall enter into force from the date of signing.

DRAFT PROTOCOL on Amendments to the Technical Annex to Customs Procedures and Document Processing to the Main Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8, 1998
In accordance with articles 10 and 11 of the Basic Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8, 1998 (hereinafter referred to as the Basic Agreement) and paragraphs 5.2, 5.3, 5.5, 7.1 and 7.3 of the Strategy of the TRACECA Intergovernmental Commission for the Development of the Europe-Caucasus International Transport Corridor - Asia (TRACECA) for the period up to 2015, approved at the meeting of the TRACECA Intergovernmental Commission in Sofia (Republic of Bulgaria, May 2-3, 2006), it was decided to make the following additions to the Technical Annex on Customs Procedures and Document Processing to the Main Agreement:
1. Add the following sub-paragraphs to paragraph 1 of Article 2 "International Conventions" of the Technical Annex on Customs Procedures and Document Processing to the Main Agreement: Kyoto Convention (International Convention on Simplification and Harmonization of Customs Procedures - 1999); Convention on the Customs Processing of Containers Transferred to the Pool - 1994; e. Agreement on the Introduction of Uniform Technical Regulations for Wheeled Vehicles (AETR) - 1998; g. The UNECE Convention on the Liability of Operators of Transport Terminals in International Trade - 1991; Convention on the International Carriage of Dangerous Goods by Road (ADR); and Agreement on the International Carriage of Perishable Foodstuffs (ATP); Convention on the Facilitation of International Maritime Navigation - 1965 (FAL Convention); L. International Convention on Safe Containers - 1972 (CSC Convention); M. International Convention on Maritime Search and Rescue, 1979 (SAR Convention); n. Convention on the International Maritime Satellite Organization - 1976 (Inmarsat Convention); O. International Convention on Intervention on the High Seas in the Event of Accidents Resulting in Oil Pollution, 1969 (Convention on Intervention); para. Rules for the International Carriage of Dangerous Goods by Rail - 1996 (RID Convention).
2. Add paragraph 3 to Article 3 "Customs control" as follows: "3. Provided that the procedures applied to transit transportations are carried out in accordance with the requirements of the customs legislation of the relevant state, goods in international, including transit transportations: as a rule, are not subject to customs inspection en route, except for inspection during transportation to the extent deemed necessary. to ensure compliance with the rules and regulations for which the relevant Customs service is responsible. Based on this, the customs services, if possible, limit themselves to the control of customs seals and other customs security measures at points of import and export; they will not be subject to any customs formalities or requirements in addition to those applied under the customs transit regime used for this transit operation.".
3. Add the following paragraph to paragraph 2 of Article 4 "Document processing": "In order to simplify customs procedures and shorten transit time for goods and transport companies (land, rail and sea) engaged in cargo transportation within the framework of the Main Multilateral Agreement on International Transport for the Development of the Europe-Caucasus-Asia Corridor dated September 8. In 1998, the TRACECA (Transport Corridor Europe - Caucasus - Asia) sign (logo) will be indicated in the cargo customs declaration. The parties will develop a procedure for the application of simplified cargo clearance issued by such a cargo customs declaration."
4. To supplement the Technical Annex on Customs Procedures and Document Processing of the Basic Agreement with Article 5 as follows:
" Article 5 - Assistance to transit
In order to facilitate international trade and transit of goods, a Party: (a) if it is the country of origin, takes all possible measures to ensure the completeness and accuracy of the information required for subsequent transit operations; (b) if it is the country of destination: takes all necessary measures to ensure that goods are cleared during Customs transit, as a rule, at the customs office at the destination of the goods; makes efforts to clear the goods in a place as close as possible to the final destination of the goods.".
5. This Protocol shall enter into force in the manner prescribed by Articles 11 and 13 of the Basic Agreement.
