On the introduction of a state of emergency in the city of Zhanaozen, Mangystau region
Decree of the President of the Republic of Kazakhstan dated December 17, 2011 No. 197
In order to ensure the safety of the population of the city of Zhanaozen, Mangystau region, in accordance with subparagraph 16) articles 44 of the Constitution of the Republic of Kazakhstan and articles 4, 5, 6 of the Law of the Republic of Kazakhstan "On the State of Emergency"
I DECREE:
1. In connection with the mass riots that occurred on December 16, 2011 in the city of Zhanaozen, Mangystau region, in order to ensure public safety, restore law and order, and protect the rights and freedoms of citizens, impose a state of emergency within the borders of the city of Zhanaozen, Mangystau region, for the period from 6 p.m. on December 17, 2011, until 7 a.m. minutes of January 5, 2012.
2. Introduce a curfew in the city of Zhanaozen, Mangystau region, from 23:00 to 7:00 for the duration of the state of emergency.
3. To establish, for the period of the state of emergency, the commandant's office of the city of Zhanaozen, Mangystau region, and to empower it with the powers provided for by the Law of the Republic of Kazakhstan "On the State of Emergency". Appoint Kabylov Amanzhol Zhaigaliuly, Head of the Department of Internal Affairs of the Mangystau region, as the commandant of the city of Zhanaozen, Mangystau region.
4. To introduce the following measures and temporary restrictions for the period of the state of emergency: 1) to strengthen the protection of public order, the protection of particularly important state and strategic facilities, as well as facilities that ensure the livelihoods of the population and the functioning of transport; 2) to establish restrictions on freedom of movement, including vehicles, in the city of Zhanaozen, Mangystau region; 3) ensure the verification of identity documents of individuals, personal inspection, inspection of their belongings, vehicles; 4) restrict entry to and exit from the city of Zhanaozen, Mangystau region; 5) prohibit meetings, rallies and demonstrations, marches and picketing, as well as entertainment, sports and other mass events; 6) prohibit strikes and other methods of suspending or terminating the activities of legal entities; 7) restrict or prohibit the use of copying and multiplying equipment, radio and television transmission equipment, audio and video recording equipment, as well as to temporarily withdraw sound-amplifying equipment; 8) prohibit the sale of weapons, ammunition, explosives, special equipment, toxic substances, establish a special regime for the turnover of medicines, narcotic drugs, psychotropic substances, precursors, as well as ethyl alcohol, alcoholic products; 9) ensure the temporary seizure of weapons and ammunition, toxic substances from individuals, and temporary seizure from legal entities along with weapons, ammunition and toxic substances, as well as combat and training military equipment, explosives and radioactive substances.
5. To identify the Commandant's Office of Zhanaozen, Mangystau region, the Ministry of Internal Affairs of the Republic of Kazakhstan, the National Security Committee of the Republic of Kazakhstan, the Ministry of Defense of the Republic of Kazakhstan, and the Ministry of Emergency Situations of the Republic of Kazakhstan as responsible for the implementation of measures applied under the state of emergency.
6. The Prosecutor General of the Republic of Kazakhstan shall ensure the observance of legality in the implementation of measures and time limits established by this Decree.
7. The Government of the Republic of Kazakhstan should allocate the necessary funds from the reserve of the Government of the Republic of Kazakhstan to ensure the state of emergency.
8. This Decree shall enter into force from the date of signing.
