Agreement between the Government of the Republic of Kazakhstan and the Government of the Arab Republic of Egypt on the Egyptian University of Islamic Culture "Nur-Mubarak"

The Government of the Republic of Kazakhstan and the Government of the Arab Republic of Egypt, hereinafter referred to as the "Parties", based on the historical and cultural ties between the peoples of the two countries, expressing a desire to strengthen and develop friendly relations between the two countries, striving to create favorable conditions for the study of the spiritual and cultural heritage of the two peoples, agreed as follows:

Article 1

The Egyptian side is carrying out the construction of the Egyptian University of Islamic Culture "Nur Mubarak", hereinafter referred to as the "University", in Almaty (Republic of Kazakhstan) at its own expense. The University, as a property complex, includes buildings, structures, equipment and other property necessary for the functioning of the University, according to the list attached to this Agreement. After the completion of the construction of the University and its equipment by the Egyptian side, it will be provided as a gift to the Republic of Kazakhstan in accordance with the provisions of this Agreement and the legislation of the Republic of Kazakhstan.

Article 2

The University is a non-governmental educational institution with the status of a legal entity and carries out its activities in accordance with the provisions of this Agreement, the charter of the University and the legislation of the Republic of Kazakhstan. The Parties agreed that the property complex and all material and intellectual property of the University are its property and cannot be used for purposes not provided for by the University's charter.

Article 3

The University's activities will be funded by its Founders, who will be determined by the Parties as follows: The Egyptian side ensures the payment of salaries to members of the teaching staff and other employees appointed by it. The Kazakh side ensures the payment of salaries to employees appointed by it. The Kazakh side also provides coverage of expenses related to the operation of engineering communications (electricity, heat, water supply, sewerage) and the maintenance of buildings.

Article 4

The University develops curricula, programs and teaching methods in accordance with the educational standards adopted in the Republic of Kazakhstan, as well as the provisions of this Agreement.

Article 5

In order to provide overall guidance and coordination of the University's activities, the Parties will establish a Board of Trustees. The Board of Trustees is responsible for shaping the financial, cultural and educational policies of the University. The Board of Trustees develops the University's charter, which defines the conditions and rules for the appointment and completion of terms of service, and the amount of salaries for members of the University's teaching and technical staff in accordance with the laws and regulations adopted in both countries. The Board of Trustees also determines and approves the teaching methodology, the internal regulations of the University, the rules for issuing diplomas and awarding academic degrees and titles, bringing them in line with the standards of the Republic of Kazakhstan, ways of financing and forms of allocations necessary for the University's activities, and also develops a strategy for preparing the University budget and approves it.

Article 6

The Board of Trustees is formed as follows: From the Republic of Kazakhstan: 1. Minister of Culture, Information and Public Consent of the Republic of Kazakhstan - Co-Chairman; 2. Minister of Education and Science of the Republic of Kazakhstan - member; 3. Chief Mufti of the Spiritual Administration of Muslims of Kazakhstan - member; 4. Akim of Almaty city - member; 5. Vice Minister of Foreign Affairs of the Republic of Kazakhstan - member; 6. Head of the Secretariat of the Council for Relations with Religious Associations under the Government of the Republic of Kazakhstan - member; 7. Rector of Al-Farabi Kazakh State National University - Member; 8. Rector of Abylai Khan Kazakh State University of World Languages and International Relations - Member; 9. The Ambassador Extraordinary and Plenipotentiary of the Republic of Kazakhstan to the Arab Republic of Egypt is a member. From the Arab Republic of Egypt: 1. Minister of Waqfs of the Arab Republic of Egypt - Co-Chairman; 2. Mufti of the Arab Republic of Egypt - member; 3. Rector of Al-Azhar University - member; 4. Wakil Al-Azhara - member; 5. Rector of Cairo University - Member; 6. Ambassador Extraordinary and Plenipotentiary of the Arab Republic of Egypt to the Republic of Kazakhstan - member; 7-8-9. Three prominent public figures are members at the discretion of the Minister of Waqfs of the Arab Republic of Egypt.

Article 7

The Rector and Vice-Rector of the University are appointed by the Board of Trustees for a term determined by the University charter. A citizen of the Arab Republic of Egypt is appointed Rector of the University, and a citizen of the Republic of Kazakhstan is appointed Vice-rector.

Article 8

The Kazakh side provides legal protection to Egyptian University teachers and technical staff, as well as their family members, in accordance with the legislation of the Republic of Kazakhstan.

Article 9

Egyptian teaching and technical staff of the University, as well as their family members, are exempt from paying entry and exit visa fees, customs duties and taxes on the import/export of household equipment and other personal items in accordance with the legislation of the Republic of Kazakhstan. Salaries and other monetary payments made at the expense of a grant for the University's statutory activities to the teaching and technical staff of the University appointed by the Egyptian side from among the citizens of the Arab Republic of Egypt are exempt in the Republic of Kazakhstan from paying personal income tax withheld from sources of payment.

Article 10

Members of the Egyptian teaching and technical staff, as well as their family members, undertake to comply with the laws of the Republic of Kazakhstan.

Article 11

The Kazakh side will assist Egyptian teaching and technical staff and their family members in the selection and rental of housing in the Republic of Kazakhstan at the expense of the Egyptian side, and will also provide Egyptian staff with medical care on the same terms as provided for similar categories of citizens of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan.

Article 12

The parties agreed to establish a University Council with a three-year term of office and the possibility of its renewal in accordance with the University's charter.

Article 13

In the event of any disagreement in the application or interpretation of the provisions of this Agreement, the Parties will resolve them through negotiations, friendly gestures or other means that they agree on.

Article 14

This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for its entry into force. The Agreement is concluded for an indefinite period and may be amended and supplemented, which carry out the same internal procedures as under this Agreement, and which are its integral parts.

Article 15

Prior to carrying out the necessary domestic procedures under the Agreement and its entry into force, the Parties agreed that each of them, from the moment of signing the Agreement, will fulfill its obligations provided for in Articles 1 and 3 of this Agreement in order to begin the educational process in the 2001-2002 academic year. Done in Almaty on June 18, 2001, in two original copies, each in the Kazakh, Arabic and English languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will be guided by the English text.
