On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Islamic Republic of Afghanistan on cooperation in the field of education

     To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Islamic Republic of Afghanistan on cooperation in the field of education, signed in Kabul on November 22, 2009.

  Agreement between the Government of the Republic of Kazakhstan and Government of the Islamic Republic of Afghanistan on cooperation in the field of education

     The Government of the Republic of Kazakhstan and the Government of the Islamic Republic of Afghanistan, hereinafter referred to as the Parties, guided by the desire to develop cooperation in the field of education on the principles of equality and mutual benefit, based on the norms of the laws of the States of the Parties, taking into account that the future development of bilateral cooperation in the field of education can greatly contribute to the establishment and maintenance of friendship and mutual understanding between the peoples of the States The Parties have agreed on the following:

  Article 1

     The parties promote the development of cooperation in the field of higher and postgraduate education through the exchange of information on personnel training, the development and implementation of joint programs and projects.       The Parties exchange information on the system and structure of higher and postgraduate education in the States of the Parties, educational reforms and new educational technologies.

  Article 2

     On a reciprocal basis, the Parties encourage the invitation of teaching staff to conduct scientific research on issues of mutual interest or to participate in scientific educational conferences, seminars, and symposiums held in the States of the Parties on the basis of agreements signed by educational organizations.

  Article 3

     The Parties shall exchange information on the legislation of the States of the Parties in the field of education.

  Article 4

     From 2010 to 2014, the Kazakh side annually accepts 200 people from among the citizens of the Islamic Republic of Afghanistan for training, including 140 in higher education institutions and 60 in technical and vocational education organizations. Admission to higher educational institutions for medical specialties will be carried out from 2010 to 2012. The total number of students is 1,000, of which 700 are in higher education institutions, 300 are in technical and vocational education organizations. The training will be provided at the expense of the Republic of Kazakhstan until 2019 (medical specialties - until 2020).

  Article 5

     Citizens of the Islamic Republic of Afghanistan are trained in higher educational institutions of the Republic of Kazakhstan in the following fields: healthcare - 200 people (higher specialized (general medicine) - 194, Bachelor of Pharmacy - 6), agriculture - 129 (bachelor's degree - 117, Master's degree - 12), veterinary medicine - 6 (Master's degree - 6) internal law enforcement - 75 (Bachelor's degree - 75), humanities and journalism - 40 (bachelor's degree - 16, Master's degree - 24), natural sciences - 6 (Master's degree - 6), social sciences, economics and business - 18 (Master's degree- 18), art - 18 (Master's degree - 18), law - 6 (Master's degree - 6), state border protection - 45 (bachelor's degree - 45), engineering - 91 (bachelor's degree - 40, master's degree - 51) and pedagogical direction - 66 (bachelor's degree - 30, master's degree - 36)       The training of citizens of the Islamic Republic of Afghanistan in technical and vocational education organizations of the Republic of Kazakhstan is carried out according to professions and specialties determined annually by the Afghan side, taking into account the opinions and capabilities of the Kazakh side.       The footnote.   Article 6

     The Kazakh side provides citizens of the Islamic Republic of Afghanistan studying at higher and vocational educational institutions of the Republic of Kazakhstan with living quarters without rent and utilities on the basis and within the limits established by the legislation of its state.       Transportation costs from the destination to the place of study and back, and during the summer holidays, are paid annually at the expense of the Kazakh side along the route agreed upon by the Kazakh side, including outside the Republic of Kazakhstan by air, within the Republic of Kazakhstan by rail or road.       The Kazakh side pays all students, except those who study in the specialties of internal law enforcement and state border protection, a scholarship for the entire period of study in double the amount established by the legislation of their state for students.       The Kazakh side will provide students with medical care within the framework of the legislation of its state in the field of healthcare.

  Article 7

     The Kazakh side provides students with a specialty in the field of internal law enforcement with monetary allowances, food and living quarters according to the standards established for the relevant categories of military personnel of the Republic of Kazakhstan.       Citizens of the Islamic Republic of Afghanistan studying in the field of internal law enforcement must carry a national police uniform for everyday and formal wear while studying in the Republic of Kazakhstan and wear the insignia of the Islamic Republic of Afghanistan.

  Article 8

     The Kazakh side provides students with a specialty in the field of state border security with monetary allowances, food, uniforms and living quarters according to the standards established for the relevant categories of military personnel of the Republic of Kazakhstan.

  Article 9

     The citizens of the Islamic Republic of Afghanistan who are accepted to study are required to undergo language training at the preparatory departments of higher educational institutions of the Kazakh side.       The languages of instruction are determined depending on the field of study - Kazakh and Russian.

  Article 10

     Upon completion of the preparatory departments, students are assigned to higher educational institutions and organizations of technical and vocational education in the Republic of Kazakhstan in their chosen specialty.

  Article 11

     The cycles of study and the content of educational programs in the fields of internal law enforcement and protection of state borders are formed taking into account the requirements of the national interests of the Republic of Kazakhstan.

  Article 12

     The recruitment of students to preparatory departments according to the levels of education and specialties agreed by the Parties is carried out by the visiting interdepartmental commission of the Kazakh side. The costs of the work of the interdepartmental visiting admissions committee are carried out at the expense of the Kazakh side (transportation costs on arrival and departure to the Islamic Republic of Afghanistan, accommodation and daily subsistence allowance in the Islamic Republic of Afghanistan - at the expense of the Ministry of Foreign Affairs of the Republic of Kazakhstan; transportation costs within the Republic of Kazakhstan, registration of exit visas and medical insurance - at the expense of interested government agencies).       The interdepartmental admissions committee consists of representatives of the Ministry of Education and Science of the Republic of Kazakhstan - 3 people (chairman of the commission, Secretary of the Commission, member of the commission), the Ministry of Foreign Affairs of the Republic of Kazakhstan - 1 person (Deputy Chairman of the commission), the Ministry of Health of the Republic of Kazakhstan - 2 people, the Ministry of Agriculture - 1 person, the Ministry of Internal Affairs - 1 person, National Security Committee - 1 person.       The term of work of the interdepartmental admissions committee in the Islamic Republic of Afghanistan is 7 days.

  Article 13

     The Afghan side, through the media and local authorities, informs the population of the Islamic Republic of Afghanistan about recruitment to higher education institutions and organizations of technical and vocational education in the Republic of Kazakhstan.       The Afghan side collects documents, performs a medical examination of candidates for training and organizes their interviews with the on-site admissions committee.       The Afghan side provides conditions for the work of the visiting admissions committee for the recruitment of students to preparatory departments.       The Afghan side, through an authorized representative, submits issues arising in the process of educating Afghan students for consideration by the authorized body in the field of education of the Republic of Kazakhstan for making operational decisions.

  Article 14

     Training, accommodation, and medical care for students of preparatory departments and students/cadets from the Islamic Republic of Afghanistan in the Republic of Kazakhstan is carried out on the basis and within the limits of the legislation of the state of the Kazakh side.

  Article 15

     Upon completion of their studies, citizens of the Islamic Republic of Afghanistan are required to return to their homeland.

  Article 16

     The Parties recognize and establish the equivalence of state-issued educational documents issued by educational institutions of the States of the Parties.

  Article 17

     Implementation of the measures provided for in this Agreement, with the exception of articles 4, 5, 6, 7, 8, 9, 10, 11, 12, 14, 15 is implemented on the basis of the conclusion of direct agreements between the interested organizations of the States of the Parties, which should define their rights, duties and responsibilities.

  Article 18

     This Agreement does not exclude the possibility of holding other educational exchange events that will be officially approved by both Parties.

  Article 19

By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized in separate protocols and are integral parts of this Agreement.       Disputes and disagreements on the implementation of this Agreement are resolved through negotiations and mutual consultations between the competent authorities of the States of the Parties.       This Agreement does not affect the rights and obligations of the States of the Parties arising from other international treaties to which they are parties.

  Article 20

     Termination of this Agreement does not affect student exchanges, projects or programs carried out within its framework that were not completed before the date of termination of this Agreement, unless the Parties decide otherwise in each specific case.

  Article 21

     This Agreement is concluded for a period until 2021.       This Agreement shall enter into force on the date of receipt of the last written notification through diplomatic channels that the Parties have completed the internal procedures necessary for its entry into force.

     Done in Kabul on November 22, 2009, in two copies, each in the Kazakh, Dari and English languages, all texts being equally authentic. In case of discrepancies in interpretation, the Parties will refer to the English text.
