Agreement between the Government of the Republic of Kazakhstan and the Government of The Kingdom of Saudi Arabia on the provision of land for the construction of facilities of the Embassy of the Kingdom Saudi Arabia in Astana

The Government of the Republic of Kazakhstan and the Government of the Kingdom of Saudi Arabia, hereinafter referred to as the "Parties", in order to strengthen the traditional friendly relations between the two countries and ensure appropriate conditions for the stay and work of the Embassy of the Kingdom of Saudi Arabia in the Republic of Kazakhstan, have agreed as follows:
Article 1
In exchange for the transfer by the Saudi side to the Kazakh side for use on terms of gratuitous land use for a period of 49 years, followed by an extension for a similar period of land with an area of 1.2 hectares located in the Diplomatic Quarter of Riyadh in the Kingdom of Saudi Arabia for the construction of facilities of the Embassy of the Republic of Kazakhstan, the Kazakh side provides the Saudi side for use on terms of gratuitous land use for a period of 49 years, followed by an extension for a similar period, a plot of land with an area of 1.8 hectares, located in Astana, on Karasaz Street, for the construction, operation and maintenance of facilities of the Embassy of the Kingdom of Saudi Arabia.
Article 2
Paragraph of Article 5 of the Agreement on the Transfer of a Land Plot for Use on a Long-term Gratuitous Lease for the Diplomatic mission and the Ambassador's Residence (on the condition of Reciprocity), dated July 14, 2004, which corresponds to the 26th day of the 5th month of 1425 AH, does not apply to legal relations arising from this Agreement.
Article 3
The Saudi side has no right to transfer the land plot transferred to it in accordance with Article 1 of this Agreement to third parties.
Article 4
The Saudi side undertakes to comply with the legislation of the Republic of Kazakhstan in the field of urban planning and architecture.
Article 5
The land plots specified in Article 1 of this Agreement shall be transferred free from debts, rights and claims of third parties.
Article 6
All expenses for specific types of services, such as land management and topographic and geodetic and other works, construction of facilities of the Embassy of the Kingdom of Saudi Arabia, as well as maintenance and repair costs, electricity, gas, water and heat supply, and other specific types of services are paid by the Saudi side independently in accordance with the regulations and tariffs in force in the Republic. Kazakhstan.
Article 7
The Kazakh side will ensure the supply of engineering networks to the border of the land plot specified in Article 1 of this Agreement and will assist in the organization and implementation of all necessary connections to public utilities after the Saudi side timely submits the initial data for connection to public utilities in Astana.
Article 8
The Kazakh side provides timely assistance in organizing the issuance of all construction permits, approvals and approvals necessary for the planning and construction of new buildings on the land transferred to the Saudi Side in accordance with Article 1 of this Agreement, subject to mandatory compliance by the Saudi side with all applicable procedures provided for by the legislation of the Republic of Kazakhstan.
Article 9
In case of disputes and disagreements in the interpretation or application of the provisions of this Agreement, the Parties resolve them through consultations and negotiations.
Article 10
By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized by separate protocols that are integral parts of this Agreement and enter into force in accordance with Article 11.
Article 11
This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for the entry into force of this Agreement.
Done in Astana on February 4, 2009, in four copies, each in Kazakh, Arabic, Russian and English, with one copy for the Kazakh Side and three copies for the Saudi Side, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the English text.
