On the ratification of the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Korea on the provision of land for the construction of buildings of diplomatic missions of the Republic of Korea in Astana

To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Korea on the provision of land plots for the construction of buildings of diplomatic missions of the Republic of Korea in Astana, signed in Seoul on April 22, 2010.

Agreement between the Government of the Republic of Kazakhstan and The Government of the Republic of Korea on the provision of land plots for the construction of buildings of diplomatic missions of the Republic of Korea in Astana (Entered into force on August 1, 2011 - Bulletin of International Treaties of the Republic of Kazakhstan 2011, No. 5, Article 79)
The Government of the Republic of Kazakhstan and the Government of the Republic of Korea, hereinafter referred to as the Parties, in order to strengthen friendly relations between the two countries, ensure appropriate conditions for the stay and work of the Embassy of the Republic of Korea in the Republic of Kazakhstan, taking into account the Vienna Declaration The Convention on Diplomatic Relations of April 18, 1961, have agreed as follows:
Article 1
The Kazakh side provides the Korean side for a period of 49 years for temporary paid land use (lease) of land plots located in Astana, near the intersection of Obagan Street and Arganaty Street, for the construction of the Embassy of the Republic of Korea with a total area of 1 hectare and for the construction of the residence of the Ambassador of the Republic of Korea with a total area of 0.5 hectares on Obagan Street. In the event of termination of the lease, the Kazakh side shall seize the land plots provided for in this Agreement, while the Korean side retains ownership of the buildings built on the above-mentioned land plots in accordance with this Agreement.
Article 2
The land plots specified in Article 1 of this Agreement are exempt from all taxes, fees, and duties levied in accordance with the national legislation of the Republic of Kazakhstan, with the exception of land lease fees.
Article 3
Within 180 days after the entry into force of this Agreement, the Korean side shall coordinate the terms of lease of the land plots specified in Article 1 of this Agreement with local executive authorities and make a one-time payment for 49 years. The amount of rent is 34 tenge 74 tiyn per year per 1 sq.m. In case of prolongation of this Agreement, the rent payment by the Korean side is also made on a one-time basis each time for the next 49 years according to the rental rates in force in the Republic of Kazakhstan at the time of prolongation, the amount of which is formalized in a separate protocol, which is an integral part of this Agreement.
Article 4
The Korean side undertakes not to transfer the land plots specified in article 1 of this Agreement to other individuals or legal entities without the written permission of the host country.
Article 5
The Korean side undertakes to comply with the legislation in force in the Republic of Kazakhstan in the field of urban planning and architecture when designing and constructing buildings of the Embassy of the Republic of Korea.
Article 6
All expenses for specific types of services, such as land management and topographic and geodetic works, project expertise and construction of a building, as well as expenses for its maintenance and repair, electricity, gas, water and heat supply, communication services and other specific types of services on land plots specified in Article 1 of this Agreement, the Korean the party is responsible independently in accordance with the regulations and tariffs in force in the Republic of Kazakhstan.
Article 7
The Kazakh side will assist in the organization and implementation of all necessary connections to public utilities to the borders of the land plots of the Embassy of the Republic of Korea at the expense of the Kazakh side, and from the borders of these land plots on its territory - at the expense of the Korean side after the Korean side timely provides the initial data for connection to public utilities in Astana.
Article 8
The Kazakh side will assist in organizing the issuance of permits for the construction of buildings and their auxiliary structures of the Embassy of the Republic of Korea on the land plots specified in Article 1 of this Agreement, subject to mandatory compliance by the Korean side with all applicable procedures provided for by the national legislation of the Republic of Kazakhstan.
Article 9
By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are formalized in separate protocols and are its integral parts.
Article 10
Disputes and disagreements arising from the interpretation and implementation of the provisions of this Agreement shall be resolved by the Parties through mutual consultations and negotiations.
Article 11
This Agreement shall enter into force on the date of receipt of the last written notification that the Parties have completed the internal procedures necessary for its entry into force. This Agreement is valid for forty-nine (49) years and is automatically extended for a further forty-nine years, unless either Party notifies the other Party in writing of its intention not to renew it at least 1 year before the expiration of the next forty-nine years. Done on April 22, 2010 in Seoul, in two copies, each in the Kazakh, Korean, Russian and English languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties will refer to the English text.
