    To ratify the Agreement between the Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan on the use of certain sections of highways, signed in Tashkent on March 27, 1998.

                                Agreement between the Government of the Republic of Kazakhstan and           The Government of the Republic of Uzbekistan on the use of certain sections of highways*

     The Government of the Republic of Kazakhstan and the Government of the Republic of Uzbekistan, hereinafter referred to as the Parties, guided by the Agreement on the Establishment of a Single Economic Space between the Republic of Kazakhstan, the Kyrgyz Republic and the Republic of Uzbekistan dated April 30, 1994, the Treaty of Eternal Friendship between the Republic of Kazakhstan, the Kyrgyz Republic and the Republic of Uzbekistan dated January 10, 1997, based on the achieved level of economic cooperation between countries,        Desiring to ensure the efficient use of transport communications and aware of the importance and necessity of joint and coordinated use of highways, based on the need to preserve the technological unity of transport systems and reduce transport costs in order to create conditions for the free movement of passengers and cargo, we have agreed as follows:          

 

Article 1        A 24.5-kilometer section of the Jetysai-Chardara highway passing through the territory of the Republic of Uzbekistan, with a sanitary protection zone of 30 meters on both sides of the edge of the carriageway, is being transferred for temporary use for a period of ten years to the Republic of Kazakhstan free of charge (without payment).        This section of the highway runs along the western coast of the Chardara reservoir from the State border of the Republic of Kazakhstan with the Republic of Uzbekistan in the area west of the village of Makhtaly, in a general direction to the northeast through the village of Arnasai, the Arnasai discharge dam to the northwest to the State border of the Republic of Kazakhstan with the Republic of Uzbekistan.          

 

Article 2        A 24.3-kilometer section of the Syrdarya-Jizzakh highway with a sanitary protection zone of 30 meters in both directions from the edge of the carriageway passing through the territory of the Republic of Kazakhstan is being transferred for temporary use for a period of ten years to the Republic of Uzbekistan free of charge (without payment).        This section of the main highway M-39 Almaty - Bishkek - Tashkent - Termez runs from the State border of the Republic of Kazakhstan with the Republic of Uzbekistan in the area northeast of the village of Makhtazhan, in a general southwesterly direction to the State border between the Republic of Kazakhstan and the Republic of Uzbekistan in the area of the village of Tselinnoe.          

 

Article 3        The Parties undertake not to construct facilities for any purpose in the sanitary protection zones specified in Articles 1 and 2 of this Agreement.        The Parties will provide each other with conditions conducive to the free transportation of passengers and goods on the sections of highways listed in Articles 1 and 2 of this Agreement.        The Parties will arrange the placement of customs posts and points of entry and exit of vehicles on the sections of highways listed in Articles 1 and 2 of this Agreement.          

 

Article 4        Amendments and additions may be made to this Agreement by mutual agreement of the Parties, which are formalized by a protocol that is an integral part of this Agreement.        

 

 Article 5 This Agreement shall enter into force from the date on which the Parties notify each other of the completion of the internal procedures necessary for its entry into force.        At the same time, this Agreement is valid subject to unconditional compliance with the terms of the Agreement between the Government of the Republic of Uzbekistan and the Government of the Republic of Kazakhstan on the transit transportation of Passengers, Cargo and baggage, ensuring safety and security when traveling along the highways of the Republic of Uzbekistan and the Republic of Kazakhstan, signed in Tashkent on March 27, 1998.        At the same time, the Parties confirm that an indispensable condition for the fulfillment of mutual obligations under the above-mentioned Agreement is to ensure favorable conditions for the passage of vehicles of the other Party through the territory of their states.        This Agreement is valid for ten years, after which it will be automatically extended for subsequent periods until one of the Parties expresses a desire to terminate it no later than six months before the expiration of the relevant period of validity.          Done in Tashkent on March 27, 1998, in two copies in the Kazakh, Uzbek and Russian languages, all texts being equally authentic.        For the purposes of interpreting the provisions of this Agreement, the text in Russian is used.
