The Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties,
Confirming their commitment to the provisions of the Agreement between the Republic of Kazakhstan and the Russian Federation on the Basic Principles and Conditions of Use of the Baikonur Cosmodrome dated March 28, 1994, the Lease Agreement for the Baikonur Complex between the Government of the Republic of Kazakhstan and the Government of the Russian Federation dated December 10, 1994 (hereinafter referred to as the Lease Agreement) and the Agreement between the Republic of Kazakhstan and the Russian Federation on development of cooperation on the effective use of the Baikonur complex dated January 9, 2004,
Desiring to act in the interests of increasing the efficiency of the Baikonur cosmodrome through the implementation of joint international space programs and commercial space projects,
have agreed on the following:
Article 1
The subject of this Agreement is to establish an organizational and legal framework for regulating the procedure for interaction between the Parties and other participants in legal relations within the framework of cooperation on launching Soyuz-2 launch vehicles from the Baikonur cosmodrome along a new route north for launching spacecraft into circumpolar orbits.
Article 2
1. The authorized bodies responsible for coordinating the implementation of this Agreement are:
from the Kazakh Side - the Aerospace Committee of the Ministry of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan;
From the Russian Side, the State Corporation for Space Activities Roscosmos.
2. The Parties shall notify each other through diplomatic channels of changes in their authorized bodies and organizations mentioned in this Agreement.
Article 3
The terms used in this Agreement mean the following:
"the area of the fall" - a plot of land in the territory of the Kostanay region of the Republic of Kazakhstan with coordinates according to the annex, which is an integral part of this Agreement, used to receive separable parts of Soyuz-2 launch vehicles during launches from the Baikonur cosmodrome, which was not included in the impact areas leased by the Russian Federation under a Lease Agreement, in respect of which there are the positive conclusion of the state environmental assessment of the Republic of Kazakhstan and the conclusion on safety in the area of impact and along the flight path of Soyuz-2 launch vehicles;
"launch organization" means the federal State unitary enterprise Center for the Operation of Ground-Based Space Infrastructure Facilities, which operates the facilities of the Baikonur Cosmodrome in accordance with the established procedure, used for launching Soyuz-2 launch vehicles in accordance with this Agreement.;
"the organization operating the area of the fall" is a joint-stock company "Joint Kazakh-Russian enterprise "Baiterek", which uses the area of the fall and provides services for providing the area of the fall to the organization producing launches;
The Organization providing environmental support for launches is an organization subordinate to the Aerospace Committee of the Ministry of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan, specializing in the study of the impact of rocket launches from the Baikonur cosmodrome on the environment and public health.
Article 4
The organization that operates the area of the fall:
uses the land plot as a fall area (with the exception of the period from April 1 to June 30 annually) on the basis of a limited purpose land use agreement (easement) concluded with the akimat of the Dzhangeldy district of the Kostanay region of the Republic of Kazakhstan. Payment under a limited purpose land use agreement (easement) is set at rates in accordance with the legislation of the Republic of Kazakhstan.;
provides services to the launch organization for the provision of the area of impact on the basis of appropriate paid agreements (contracts). The rights, duties and responsibilities of organizations, norms and procedures of an organizational, financial, legal and technical nature related to the work (services) for the use (operation) of the fall area performed (provided) within the framework of the implementation of this Agreement are the subject of these agreements (contracts).
The launch organization, at the expense of funds allocated by the launch customer, pays the organization operating the fall area in the amount of 460,000 (four hundred and sixty thousand) US dollars per year for the use of the fall area (including no more than three launches), sent to the akimat of the Dzhangelda district of the Kostanay region of the Republic of Kazakhstan, and in the case of For additional launches, a fee is made in the amount of 50,000 (fifty thousand) US dollars for each additional launch.
Article 5
In order to ensure the safety of the population and territories, as well as environmental safety during launches of Soyuz-2 launch vehicles from the Baikonur cosmodrome, within the framework of this Agreement, the organization operating the impact area at the expense of the launch organization:
a) provides:
notification of local executive bodies and heads of farms about the upcoming launch of the launch vehicle;
reconnaissance of the impact area before the launch of the launch vehicle and temporary closure of the impact area during the launch of the launch vehicle;
evacuation of the population from the area of impact (if any) and its return after the launch of the launch vehicle;
search for fragments of the separated parts of the launch vehicle;
the return of the launch organization of the detected liquid rocket engines (or their fragments) and articles containing precious metals (or their fragments) from the separating parts of the launch vehicle;
compliance with fire safety requirements and regulations in order to reduce the impact on wildlife and vegetation, and to eliminate steppe fires as quickly as possible if they occur during the landing of the separating parts of the launch vehicle.;
timely cleaning of the impact area from fragments of the separating parts of the launch vehicle (if the separating parts fall into salt marshes, they can be evacuated from the impact area in winter);
detoxification of contaminated sites (if necessary) and technical reclamation (leveling) of the disturbed soil cover at the fall sites of the separating parts of the launch vehicle;
submission of a report on environmental support for the launch of the launch vehicle to the authorized body of the Republic of Kazakhstan in the field of environmental protection and the Aerospace Committee of the Ministry of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan and, at the end of the year, a report on monitoring the state of flora and fauna in the impact area and in the adjacent territory;
b) provides, with the involvement of an organization providing environmental support for launches:
assessment of the impact of preparation and launch of the launch vehicle on the environment of the Baikonur cosmodrome site;
assessment of the impact of the fall of the separating parts of the launch vehicle on the environment in the area of impact and settlements located on the adjacent territory;
annual monitoring of the flora and fauna in the area of the fall and in the adjacent territory;
a comprehensive assessment of the impact of launch vehicles on the environment in the impact area and in the adjacent territory once every five years or after the end of operation of the impact area.
Organizations operating under this Agreement are required to comply with the terms and measures of the project "Development of documentation on Environmental Impact Assessment (EIA) of the Republic of Kazakhstan for launches of Soyuz-2 space rockets from the Baikonur Cosmodrome during the launch of spacecraft into circumpolar orbit" (hereinafter referred to as the EIA documentation), based on which has a positive conclusion of the state environmental assessment of the Republic of Kazakhstan.
Article 6
Within three days after the launch of the Soyuz-2 launch vehicle, representatives of the authorized body of the Republic of Kazakhstan in the field of environmental protection, together with representatives of the launch organization, the organization operating the impact area, and the Akimat of the Kostanay region of the Republic of Kazakhstan, draw up an act on the results of the inspection of the impact area of the separable parts of the Soyuz launch vehicle.-2".
Environmental damage caused during the regular launch of a Soyuz-2 launch vehicle (environmental impact not provided for in the EIA documentation), as well as search and rescue forces and facilities, is reimbursed by the organization operating the impact area (in relation to the impact area and the adjacent territory) and the organization conducting the launches (in regarding the Baikonur cosmodrome). At the same time, the amount of damage and the procedure for its compensation are determined in accordance with the legislation of the Republic of Kazakhstan.
The Russian Side is responsible for damage caused as a result of the abnormal fall of the first stage of the Soyuz-2 launch vehicle in accordance with the Agreement between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on the procedure for interaction in the Event of accidents during rocket launches from the Baikonur Cosmodrome dated November 18, 1999.
Article 7
1. The launch organization interacts:
with the Main Air Traffic Control Center of the Air Defense Forces of the Armed Forces of the Republic of Kazakhstan on the use of the airspace of the Republic of Kazakhstan over the Baikonur cosmodrome and the area of impact during launches of Soyuz-2 launch vehicles in accordance with the procedure established by the legislation of the Republic of Kazakhstan.;
with the Central Command Post of the General Staff of the Armed Forces of the Republic of Kazakhstan and the Main Air Traffic Control Center of the Air Defense Forces of the Armed Forces of the Republic of Kazakhstan - in an agreed manner regarding information on hourly readiness for launch or its postponement, real-time information on the launch and flight of the Soyuz-2 launch vehicle over the territory of the Republic Kazakhstan.
2. Information about the launch and flight of the Soyuz-2 launch vehicle over the territory of the Republic of Kazakhstan is simultaneously transmitted by the launch organization to the Crisis Management Center of the Emergency Situations Committee of the Ministry of Internal Affairs of the Republic of Kazakhstan and the Aerospace Committee of the Ministry of Digital Development, Innovation and Aerospace Industry of the Republic of Kazakhstan.
3. In order to increase the safety of launches of Soyuz-2 launch vehicles, the launch organization shall ensure that measures are taken to improve the technological processes carried out at the facilities of the ground-based space infrastructure of the Baikonur cosmodrome used to prepare and launch Soyuz-2 launch vehicles in accordance with this Agreement..
Article 8
The provisions of the international treaties between the Republic of Kazakhstan and the Russian Federation on the Baikonur complex apply to issues that are not regulated by this Agreement, but relate to the launch of Soyuz-2 launch vehicles from the Baikonur cosmodrome along a new route using the impact area, with the exception of the obligations of the Russian Side. concerning the use of fall areas. The fulfillment of obligations stipulated by international treaties on the Baikonur complex related to the use of fall areas in relation to the fall area is ensured by the organization operating the fall area, in coordination with the authorized bodies of the Republic of Kazakhstan in the field of environmental protection and land management.
The parties are not responsible for obligations arising from agreements (contracts) concluded by cooperating organizations.
Article 9
In cases of disputes between the Parties related to the interpretation and/or execution of this Agreement, the Parties, through their authorized bodies, conduct consultations or negotiations to resolve them.
Article 10
By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are its integral parts and are formalized by separate protocols that enter into force in accordance with the procedure provided for the entry into force of this Agreement.
Article 11
1. This Agreement is concluded for a period of 5 years and is automatically extended for subsequent 5-year periods, unless either Party notifies the other Party in writing through diplomatic channels of its intention to terminate it at least 6 months before the expiration of the current 5-year period.
2. This Agreement shall enter into force 30 days after the date of receipt, through diplomatic channels, of the last written notification by the Parties of the completion of the internal procedures necessary for its entry into force.
3. Termination of this Agreement in accordance with the procedure provided for in paragraph 1 of this Article shall not affect the obligations of the Parties to settle financial obligations incurred during the period of validity of this Agreement.
Done in the city of Nur-Sultan on June 20, 2019, in two copies, each in the Kazakh and Russian languages, both texts being equally authentic. In case of discrepancy between the texts of this Agreement, the Parties refer to the text in Russian.
