Agreement between the Government of the Republic of Kazakhstan and the Government of The State of Palestine on the provision of office space in Astana for free use for the needs of Embassies of the State of Palestine in the Republic of Kazakhstan

The Government of the Republic of Kazakhstan and the Government of the State of Palestine, hereinafter referred to as the "Parties", in order to ensure appropriate conditions for the stay and work of the Embassy of the State of Palestine in the Republic of Kazakhstan, have agreed as follows:

Article 1

The Kazakh Side transfers office space and adjacent territories located in Astana for free use for a period of 3 years to the Embassy of the State of Palestine.

Article 2

The office space and adjacent territories specified in Article 1 of this Agreement and hereinafter referred to as the "Premises" are transferred to the Palestinian Side for use for the needs of the Embassy of the State of Palestine in the Republic of Kazakhstan.

Article 3

The premises are exempt from all types of taxes and fees levied in the Republic of Kazakhstan.

Article 4

The Palestinian Side carries out all costs related to the capital and routine repairs of the Premises at its own expense and bears full responsibility for the integrity, safety and serviceable condition of all built-in technical equipment of the building and adjacent territories, as well as independently pays for telephone and Internet services according to invoices issued by service providers. The Kazakh Side undertakes to make payments for electricity, heat supply, water supply and sewerage based on meter readings, or according to the established monthly rate.

Article 5

The actual transfer of Premises for the needs of the Embassy of the State of Palestine in the Republic of Kazakhstan is carried out by signing acceptance certificates by the relevant persons. The Kazakh Side undertakes to provide the Palestinian Side with all necessary documentation related to the transferred premises. The Kazakh Side undertakes to make the actual transfer of the premises in the condition in which it was at the time of signing this Agreement.

Article 6

By mutual agreement of the Parties, amendments and additions may be made to this Agreement, which are integral parts of this Agreement and are formalized in separate protocols.

Article 7

This Agreement shall enter into force on the date of receipt, through diplomatic channels, of the last written notification that the Parties have completed the internal procedures necessary for its entry into force. This Agreement is concluded for a period of three (3) years and its validity is automatically terminated if neither Party notifies the other Party in writing through diplomatic channels of its intention to extend its validity no later than six (6) months before the expiration of the current period.

Done in Astana on September 16, 2010, in two copies, each in the Kazakh, Arabic and English languages, all texts having the same legal force. In case of disagreement in the interpretation of the provisions of this Agreement, the Parties shall refer to the English text.
