     The Republic of Kazakhstan and the Kyrgyz Republic, hereinafter referred to as the High Contracting Parties, in order to clarify and determine the line of the Kazakh-Kyrgyz state border, in accordance with the Almaty Declaration on the Establishment of the Commonwealth of Independent States dated December 21, 1991, the Treaty of Eternal Friendship between the Republic of Kazakhstan and the Kyrgyz Republic dated April 8, 1997, the Memorandum on Delimitation the State border between the Republic of Kazakhstan and the Kyrgyz Republic dated July 17, 1998,         According to generally accepted norms of international law, we have agreed on the following:  

  Article 1  

The High Contracting Parties have agreed, on the basis of the existing administrative-territorial delimitation between the former Kazakh SSR and the Kyrgyz SSR, on the following state border line between the Republic of Kazakhstan and the Kyrgyz Republic (hereinafter referred to as the state border):         The starting point of the Kazakh-Kyrgyz state border line is the junction point of the state borders of the Republic of Kazakhstan, the People's Republic of China and the Kyrgyz Republic, located at the top of Khan Tengri Peak.         From the above-mentioned junction point, the state border line runs in a straight line in a north-northwesterly direction, crossing the Severny Inylchek Glacier, to border point No. 1.         This boundary point is located at the top of Semenov Peak with a mark of 5816.0 at a distance of 4.7 km to the west of the height with a mark of 5841.0, located on the territory of the Republic of Kazakhstan, and at a distance of 4.0 km to the east of the height with a mark of 5378.0, located on the territory of the Kyrgyz Republic.         The length of the state border between the junction point and border point No. 1 is 8.7 km.         From border point No. 1, the state border line runs along the crest of the Sarydjaz ridge in a general east-northeast direction to border point No. 2.         This boundary point is located on the crest of the Sarydjaz ridge at an altitude of 5437.0, 2.7 km west of the altitude of 5841.0, located on the territory of the Republic of Kazakhstan, and 3.0 km east of the altitude of 5240.0, located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 1 and N 2 is 2.3 km.         From border point No. 2, the state border line runs along the crest of the Katta-Ashutor ridge in a general northwesterly direction through the heights at 4651.0 and 4777.0 to border point No. 3.         This boundary point is located on the crest of the Katta-Ashutor ridge at an altitude of 4685.0, at a distance of 3.8 km west-southwest of the altitude of 4520.0, located on the territory of the Republic of Kazakhstan, and at a distance of 4.5 km east-northeast of the altitude of 4505.0, located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 2 and N 3 is 7.3 km.         From border point No. 3, the state and Sarkyramasai rivers, at a distance of 1.1 km south-southeast of the elevation with a mark of 1086.0, located on the territory of the Republic of Kazakhstan, and at a distance of 1.7 km northwest of the geodetic point with a mark of 1194.4, located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 73 and N 74 is 6.4 km.         From border point No. 74, the state border line runs in a general southwesterly direction downstream of the Almalysai riverbed to border point No. 75.         This border point is located at the intersection of the drying Almalysai riverbed with a country road leading to the settlement of Dzhayilgan, at a distance of 1.0 km south-southwest of the geodetic point with the mark 779.3, located on the territory of the Republic of Kazakhstan, and at a distance of 1.3 km west-southwest of the geodetic point with the mark 788.4, located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 74 and N 75 is 9.6 km.         From border point N 75, the state border line runs in a north-northeasterly direction along a country road, turns northwest after 0.25 km and runs along the southwestern side of the paved road to border point N 76.         This boundary point with coordinates X = 4741.79, Y = 12712.46 is located on the southwestern side of the paved road, 0.7 km west of the geodetic point with a mark of 779.3 located on the territory of the Republic of Kazakhstan, and 1.4 km northeast of the elevation point with a mark of 738.4 located on the territory of the Kyrgyz Republic. This boundary point is located in the middle of the Talas River water flow, at a distance of 2.5 km south-southwest of the geodetic point with a mark of 757.9 located on the territory of the Republic of Kazakhstan, and at a distance of 2.7 km north of the elevation point with a mark of 724.9 located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 77 and N 78 is 4.5 km.         From the border point N 78, the state border line runs in a straight line in a southwesterly direction, crossing an arm of the Talas River, for 1.0 km to the border point N 78/1 with coordinates X = 4743.75, Y = 12707.45, turns and runs in a straight line in a west-southwesterly direction for 0.65 km to the border point N 78/2 with coordinates X = 4743.60, Y = 12706.80, located on the Grodikovo-Uch-Korgon highway, then turns and goes in a straight line in a southwesterly direction for 0.5 km to the border point N 78/3 with coordinates X = 4743.25, Y = 12706.45, located at the turn of the ditch, it continues in a general west-southwesterly direction along the ditch to the border point N 79.         This boundary point is located at the turn of the ditch at a distance of 1.1 km northwest of the geodetic point with a mark of 727.8, located on the territory of the Kyrgyz Republic, and at a distance of 1.9 km south-southeast of the elevation point with a mark of 698.5, located on the territory of the Republic of Kazakhstan.         The length of the state border between border points N 78 and N 79 is 3.3 km.         From border point No. 79, the state border line runs in a general northwesterly direction along the aryk, crossing the Grodikovo-Kyzyl-Jildiz highway for 0.9 km to border point No. 79/1, located at a distance of 1.7 km southeast of the geodetic point with a mark of 695.7, located on the territory of the Republic of Kazakhstan, and on at a distance of 1.8 km to the north-northeast of the elevation point with a mark of 712.3, located on the territory of the Kyrgyz Republic. Then the state border line turns and runs in a straight line in a west-southwesterly direction between the collector and the highway for 2.5 km to the border point N 79/2, located on an unnamed canal, turns and runs in a general south-south-easterly direction along the canal to the border point N 79/3, located on the canal, at a distance of 2.2 km to the east-southeast of the geodetic point with a mark of 696.5, located on the territory of the Republic of Kazakhstan, and at a distance of 0.8 km to the west-northwest of the elevation point with a mark of 706.4, located on the territory of the Kyrgyz Republic, it then turns and runs in a straight line in a west-southwesterly direction for 0.1 km to the border point N 80.         This boundary point is located at the turn of the collector, at a distance of 1.8 km west-northwest of the elevation point with a mark of 712.3, located on the territory of the Kyrgyz Republic, and at a distance of 2.1 km south-southeast of the geodetic point mark 689.5, located on the territory of the Republic of Kazakhstan.         The length of the state border between border points N 80 and N 81 is 5.5 km.         From the border point N 81, the state border line runs in a straight line in a westerly direction to the border point N 82.         This border point is located on the Taraz-Amanbaevo highway, 0.7 km southwest of the geodetic point with a The length of the state border between border points N 90 and N 91 is 2.3 km.         From border point No. 91, the state border line runs in a general westerly direction along a dirt road to its intersection with the Kara-Taka irrigation ditch and then along a field road to border point No. 92.         This boundary point is located at the turn of the dry ditch, at a distance of 4.7 km south-southwest of the geodetic point with a mark of 1005.0, located on the territory of the Republic of Kazakhstan, and at a distance of 2.0 km west of the geodetic point with a mark of 1090.8, located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 91 and N 92 is 13.0 km.         From the border point N 92, the state border line runs in a straight line in a southerly direction to the border point N 93.         This boundary point with coordinates X = 4717.62, Y = 12664.33 is located on a field road, 2.5 km south of the elevation the Talassky Alatau ridge, at a distance of 1.4 km east-southeast of the geodetic point with a mark of 3809.0 located on the territory of the Republic of Kazakhstan, and at a distance of 1.6 km northwest of the height with a mark of 3389.0 located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 103 and N 104 is 11.9 km.         From the border point N 104, the state border line runs along the crest of the Talassky Alatau ridge in a general southeasterly direction through the height at 3649.3, the Maidantal Pass at 3520.6, the height at 3710.4, the geodetic point at 3840.3, the height at 3901.0 to the border point N 105.         This boundary point is located on the crest of the Talassky Alatau ridge on the Tuzashu pass with a mark of 3695.0, at a distance of 3.4 km north-northeast of the height with a mark of 3789.7, located on the territory of the Republic of Kazakhstan, and at a distance of 2.6 km south-southwest of the height with a mark of 4054.0, located on the territory of the Kyrgyz Republic.         The length of the state border between border points N 104 and N 105 is 11.4 km.         From the border point No. 105, the state border line runs along the crest of the Talassky Alatau ridge in a general east-southeasterly direction to the junction of the state borders of the Republic of Kazakhstan, the Kyrgyz Republic and the Republic of Uzbekistan.         The length of the state border from the border point N 105 to the aforementioned junction point is 1.8 km.  

  Article 2  

     The state border line described in article 1 of this Treaty is marked in red on topographic maps of the former USSR on a scale of 1:50,000.         The line of the state border in the area of the Chu River, described in Article 1 of this Treaty, is marked in red on updated maps at a scale of 1:50,000 K.-43-44- A,B; K-43-43- B,G; K-43-43- A; K-43-30- G, 42-B; K-43-30- B, 42-A; K-43-29- B,G; K-43-29- A.         The spelling of geographical names used in the description texts in Kazakh, Kyrgyz and Russian correspond to the above maps.         The above-mentioned maps with the red line of the state border are attached to this Agreement and form an integral part of it.  

  Article 3  

The High Contracting Parties have agreed that, instead of the topographic maps specified in paragraph 1 of Article 2 of this Treaty, updated 1:50,000 scale topographic maps of the State border will be published, which, after proper joint legal registration, will form an integral part of this Treaty.  

  Article 4  

     Any natural changes that may occur in the border area, including on the border rivers, do not entail changes in the position of the state border line.  

  Article 5  

     The High Contracting Parties agreed to conclude a separate agreement on the management and use of the Chumyshsky hydrotechnical hub on the Chu River.  

  Article 6  

     The High Contracting Parties will resolve all issues regarding the interpretation or application of the provisions of this Treaty through consultations and negotiations.  

  Article 7  

     This Agreement is open-ended and is not subject to denunciation.         This Treaty is subject to ratification and shall enter into force on the date of the exchange of instruments of ratification.         This Agreement was signed in Astana on December 15, 2001 in two original copies, each in Kazakh, Kyrgyz and Russian languages, and all texts have the same validity.         In case of disagreement in the interpretation of the provisions of this Treaty, the High Contracting Parties will refer to the text in Russian.
