The length of the state border between border points N 103 and N 104 is 11.9 km. From the border point N 104, the state border line runs along the crest of the Talassky Alatau ridge in a general southeasterly direction through the height at 3649.3, the Maidantal Pass at 3520.6, the height at 3710.4, the geodetic point at 3840.3, the height at 3901.0 to the border point N 105. This boundary point is located on the crest of the Talassky Alatau ridge on the Tuzashu pass with a mark of 3695.0, at a distance of 3.4 km north-northeast of the height with a mark of 3789.7, located on the territory of the Republic of Kazakhstan, and at a distance of 2.6 km south-southwest of the height with a mark of 4054.0, located on the territory of the Kyrgyz Republic. The length of the state border between border points N 104 and N 105 is 11.4 km. From the border point No. 105, the state border line runs along the crest of the Talassky Alatau ridge in a general east-southeasterly direction to the junction of the state borders of the Republic of Kazakhstan, the Kyrgyz Republic and the Republic of Uzbekistan. The length of the state border from the border point N 105 to the aforementioned junction point is 1.8 km.
Article 2
The state border line described in article 1 of this Treaty is marked in red on topographic maps of the former USSR on a scale of 1:50,000. The line of the state border in the area of the Chu River, described in Article 1 of this Treaty, is marked in red on updated maps at a scale of 1:50,000 K.-43-44- A,B; K-43-43- B,G; K-43-43- A; K-43-30- G, 42-B; K-43-30- B, 42-A; K-43-29- B,G; K-43-29- A. The spelling of geographical names used in the description texts in Kazakh, Kyrgyz and Russian correspond to the above maps. The above-mentioned maps with the red line of the state border are attached to this Agreement and form an integral part of it.
Article 3
The High Contracting Parties have agreed that, instead of the topographic maps specified in paragraph 1 of Article 2 of this Treaty, updated 1:50,000 scale topographic maps of the State border will be published, which, after proper joint legal registration, will form an integral part of this Treaty.
Article 4
Any natural changes that may occur in the border area, including on the border rivers, do not entail changes in the position of the state border line.
Article 5
The High Contracting Parties agreed to conclude a separate agreement on the management and use of the Chumyshsky hydrotechnical hub on the Chu River.
Article 6
The High Contracting Parties will resolve all issues regarding the interpretation or application of the provisions of this Treaty through consultations and negotiations.
Article 7
This Agreement is open-ended and is not subject to denunciation. This Treaty is subject to ratification and shall enter into force on the date of the exchange of instruments of ratification. This Agreement was signed in Astana on December 15, 2001 in two original copies, each in Kazakh, Kyrgyz and Russian languages, and all texts have the same validity. In case of disagreement in the interpretation of the provisions of this Treaty, the High Contracting Parties will refer to the text in Russian.
