      To ratify the Agreement between the Republic of Kazakhstan and Turkmenistan on the Delimitation of the Kazakh-Turkmen state border and the Delimitation of Adjacent Fishing Zones in the Caspian Sea, signed in Ashgabat on October 25, 2021.

AGREEMENT between the Republic of Kazakhstan and Turkmenistan on the delimitation of the Kazakh-Turkmen State border and the delimitation of adjacent fishing zones in the Caspian Sea

     The Republic of Kazakhstan and Turkmenistan, hereinafter referred to as the Parties, wishing to strengthen the historical bonds of friendship between the two States,

     Based on the Agreement between the Republic of Kazakhstan and Turkmenistan on the Delimitation and Demarcation of the Kazakh-Turkmen State Border dated July 5, 2001, as well as the Agreement between the Republic of Kazakhstan and Turkmenistan on the Demarcation of the Kazakh-Turkmen State Border dated April 18, 2017,

     Guided by the provisions of the Convention on the Legal Status of the Caspian Sea of August 12, 2018 (hereinafter referred to as the Convention), as well as the principles and norms of international law,

     Desiring to determine the passage of the lines of the state border and the delimitation of fishing zones in the Caspian Sea between the Republic of Kazakhstan and Turkmenistan,

     Emphasizing that the State border between the Republic of Kazakhstan and Turkmenistan is the border of peace and harmony between the States of the two fraternal peoples,

     Convinced that this Agreement will contribute to the further strengthening of good-neighborliness and the development of mutually beneficial and equal cooperation between the Parties,

     Striving to ensure favorable conditions for the realization of the exclusive rights of the Parties to fish for aquatic biological resources,

     We have agreed on the following:

Article 1

     By this Agreement, the Parties have defined the line of the state border between the Republic of Kazakhstan and Turkmenistan on the Caspian Sea, delimiting their territorial waters (hereinafter referred to as the maritime state border), and the line of demarcation of adjacent sections of fishing zones between the Republic of Kazakhstan and Turkmenistan on the Caspian Sea (hereinafter referred to as the line of demarcation of fishing zones).

     The terms used in this Agreement have the meaning defined in the Convention.

Article 2

     The line of the maritime state border and the line of demarcation of fishing zones run along geodetic lines connecting the turning points, in full compliance with Articles 4 and 5 of this Treaty.

Article 3

     The line of the maritime state border is based on the long-term average level of the Caspian Sea, equal to minus 28.0 meters of the 1977 Baltic elevation system relative to the zero of the Kronstadt footstock.

     The line of demarcation of fishing zones is built from the end point of the maritime state border.

     The coordinates of the turning points of the maritime state border line and the line of demarcation of fishing zones are determined on the basis of cartographic materials agreed by the Parties in the 1942 coordinate system.

Article 4

     The starting point No. 1 of the maritime State border line is border point No. 13, specified in Annex 1 to the Agreement between the Republic of Kazakhstan and Turkmenistan on the Delimitation and Demarcation Process of the Kazakh-Turkmen State Border dated July 5, 2001, and corresponding to the endpoint (162) of the demarcated state border line specified in the Agreement between the Republic of Kazakhstan and Turkmenistan. Turkmenistan on the demarcation of the Kazakh-Turkmen state border dated April 18, 2017, with coordinates 41°45'42.9” north latitude, 52°26'46.4” east longitude.

     From the starting point No. 1, the line of the maritime state border runs in a west-southwesterly direction to point No. 2.

     Point No. 2 has coordinates 41o44’00.0" north latitude, 52°18'54.0” east longitude.

     The length of the maritime state border line between points No. 1 and No. 2 is 6.14 nautical miles.

     From point No. 2, the line of the maritime state border runs in a west-southwesterly direction to point No. 3.

     Point No. 3 has coordinates 41°43'18.0” north latitude, 52°14’30.0” east longitude.

     The length of the maritime state border line between points No. 2 and No. 3 is 3.37 nautical miles.

     From point No. 3, the maritime state border line runs in a west-southwesterly direction to the end point No. 4.

     Point No. 4 has coordinates 41°41’33.2” north latitude, 52°07'30.6” east longitude.

     The length of the maritime state border line between point No. 3 and point No. 4 is 5.52 nautical miles.

     The total length of the maritime state border line is 15.03 nautical miles, taking into account the presence of turning points.

     The territorial waters are 15 nautical miles wide.

Article 5

     The starting point No. 1 of the line of demarcation of fishing zones is point No. 4, which is the endpoint of the maritime state border line with coordinates 41°41’33.2” north latitude, 52°07’30.6" east longitude.

     From the starting point No. 1, the line of demarcation of fishing zones runs in a west-southwesterly direction to point No. 2.

     Point No. 2 has coordinates 41°41’24.0" north latitude, 52°06'54.0" east longitude.

     The length of the line of demarcation of fishing zones between points No. 1 and No. 2 is 0.48 nautical miles.

     From point No. 2, the line of demarcation of fishing zones runs in a westerly direction to the end point No. 3.

     Point No. 3 has coordinates 41°40'41.0” north latitude, 51°54'00.5" east longitude.

     The length of the line of demarcation of fishing zones between point No. 2 and point No. 3 is 9.69 nautical miles.

     The total length of the line of demarcation of fishing zones is 10.17 nautical miles, taking into account the presence of turning points.

     The width of the fishing zones is 10 nautical miles.

Article 6

     Any natural changes in the terrain, including fluctuations in the level of the Caspian Sea, do not entail changes in the course of the maritime state border and the line of demarcation of fishing zones.

Article 7

     All issues regarding the interpretation and application of the provisions of this Agreement are resolved through negotiations and consultations.

Article 8

     This Treaty is indefinite, is not subject to denunciation and enters into force on the date of receipt through diplomatic channels of the last written notification of its ratification.

     Done in the city of Ashgabat on October 25, 2021, in two copies, each in the Kazakh, Turkmen and Russian languages, all texts being equally authentic.

     In case of disagreement in the interpretation of the provisions of this Agreement, the Parties shall use the text in Russian.
