On the ratification of the Agreement on Cooperation in the Creation and Application of Standard Samples of the Composition and Properties of Substances and Materials

      To ratify the Agreement on Cooperation on the Creation and Application of Standard Samples of the Composition and Properties of Substances and Materials, signed in Moscow on October 25, 2019.

AGREEMENT on cooperation in the creation and application of standard samples of the composition and properties of substances and materials

     (Entered into force on March 23, 2022, Bulletin of International Treaties of the Republic of Kazakhstan 2022, No. 1, art. 6)

     The Governments of the States Parties to this Agreement, hereinafter referred to as the Parties,

     in order to cooperate in the implementation of the provisions of the Agreement on the Implementation of a Coordinated Policy in the Field of Standardization, Metrology and Certification dated March 13, 1992,

     considering the economic feasibility of cooperation to ensure the uniformity and reliability of measurements,

     being interested in the effective operation of metrological services for testing, metrological certification, verification and calibration of measuring instruments, in metrological support for measurements of testing and other laboratories performing tests of substances and materials in product quality and safety control, ensuring the safety of human life and health and the environment, scientific research and other areas,

     Aware of the important role of standard samples of the composition and properties of substances and materials to ensure the uniformity, reliability of measurements, metrological support of measurements and tests,

     Desiring to meet the needs of the States Parties to this Agreement in standard samples of substances and materials,

     Taking into account the need to preserve the operation of the rules on interstate standardization with the abbreviation "PMG" and standards with the abbreviation "GOST" as interstate and primarily form requirements for standard samples of the composition and properties of substances and materials, metrological norms and rules for their development, creation and application.,

      have agreed on the following:

Article 1

     The Parties, having full independence in carrying out their activities to ensure the uniformity of measurements of the composition and properties of substances and materials:

     ensure cooperation on the creation and application of interstate standardization documents (rules, standards, recommendations) in the field of standard samples of the composition and properties of substances and materials on the basis of programs (plans) and procedures agreed upon by national bodies for metrology (ensuring the uniformity of measurements).;

     Ensure cooperation on the creation and application of standard samples of the composition and properties of substances and materials on the basis of programs (plans) and procedures agreed upon by national metrology authorities (ensuring the uniformity of measurements).;

     organize the approval of types of standard samples by the authorized body for metrology (ensuring the uniformity of measurements) in accordance with national legislation and their entry into the national register of approved types of standard samples.;

     organize the exchange of information on approved types of standard samples of the composition and properties of substances and materials being created and used in the territories of their States;

     ensure, on their own initiative or on the recommendation of the national body for metrology (ensuring the uniformity of measurements) of the States Parties to this Agreement, the submission of types of national standard samples as the States producing standard samples of these types for recognition as interstate standard samples.

Article 2

     The Parties shall carry out coordinated work on the creation and application of standard samples of the composition and properties of substances and materials, based on the provisions of international regulatory and technical documents, as well as documents adopted by the Interstate Council for Standardization, Metrology and Certification (IGC), national standards and other documents relevant to the subject of this Agreement.

Article 3

     The creation of interstate standard samples of the composition and properties of substances and materials is carried out by developing new types of standard samples or based on the recognition of approved types of national standard samples of the States Parties to this Agreement. The decision on the recognition of interstate standard samples is made by the MGS. The creation, recognition and application of interstate standard samples are carried out in accordance with the procedure provided for by SGP 16 "Regulations on the Interstate Standard Sample".

     Interstate standard samples recognized by the MGS are subject to entry in the Register of Interstate Standard Samples of the Composition and Properties of Substances and Materials, maintained by the Bureau of Standards of the MGS.

     The information on interstate standard designs and information on the States that have joined their recognition is posted by the Bureau of Standards of the IGS on the official website of the IGS.

Article 4

     Interstate standard samples are used in various fields of the economy, including in the field of state regulation of ensuring the uniformity of measurements of the States Parties to this Agreement that have joined their recognition, without additional tests or studies and type approval of the national standard sample in accordance with the legislation of the States Parties to this Agreement.

     The Parties shall provide conditions for the use of interstate standard samples in economic, scientific and technical cooperation by including (referencing) them in standards, agreements or agreements (contracts) for metrological support of measurements, testing of substances and materials, calibration, verification, certification of measuring instruments, as well as inclusion (references) in documents on methods (methods) measurements, tests, calibrations, verifications, test programs, attestations.

Article 5

     This Agreement applies to interstate standard samples recognized by the International Customs Union before and after the signing of this Agreement.

Article 6

     Issues of legal protection and use of inventions, industrial designs and trademarks related to interstate standard designs are regulated by the legislation of the States Parties to this Agreement.

Article 7

     This Agreement does not affect the rights and obligations of each of the Parties arising from other international treaties to which its State is a party.

Article 8

     This Agreement may be amended by agreement of the Parties, which are an integral part of it, which are formalized by the relevant protocol.

Article 9

     Disputes between the Parties arising from the application and interpretation of this Agreement shall be resolved through consultations and negotiations between the Parties concerned or through another procedure agreed upon by the Parties.

Article 10

     This Agreement shall enter into force 30 days after the date of receipt by the depositary of the third notification that the Signatories have completed the internal procedures necessary for its entry into force.

     For the Parties that have completed the internal procedures later, this Agreement shall enter into force 30 days after the date of receipt by the depositary of the relevant documents.

Article 11

     After its entry into force, this Agreement is open for accession by other States by submitting an instrument of accession to the depositary.

     For a CIS member State, this Agreement shall enter into force 30 days after the date of receipt by the depositary of the instrument of accession.

     For a non-CIS State, this Agreement shall enter into force 30 days after the date of receipt by the depositary of the last notification of the consent of the signatory or acceding States to such accession.

Article 12

     This Agreement is concluded for an indefinite period. Each of the Parties has the right to withdraw from this Agreement by sending a written notification to the depositary of its intention no later than 6 months before withdrawal and having settled the obligations of the Party under this Agreement that arose during its validity.

     Done in Moscow on October 25, 2019, in one original copy in Russian. The original copy is kept in the Executive Committee of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Agreement.

     I hereby certify that the attached text is an authentic copy of the Agreement on Cooperation on the Creation and Application of Standard Samples of the Composition and Properties of Substances and Materials, signed at the meeting of the Council of Heads of Government of the Commonwealth of Independent States, which took place on October 25, 2019 in Moscow. The original copy of the above-mentioned Agreement is kept in the Executive Committee of the Commonwealth of Independent States.
