On the ratification of the Agreement on Export Customs Duties in Respect of Third Countries

AGREEMENT on Export Customs Duties in respect of Third Countries
The Government of the Republic of Belarus, the Government of the Republic of Kazakhstan and the Government of the Russian Federation, hereinafter referred to as the Parties, have agreed as follows:
Article 1
Each Party shall draw up a list of goods supplied to States that are not parties to this Agreement (hereinafter referred to as third countries), in respect of which, as of the date of entry into force of this Agreement, the legislation of the State of the Party provides for the application of export customs duties, indicating the rates of these duties (hereinafter referred to as the list of goods) and within 30 calendar days from the date of entry into force of this Agreement. After the entry into force of this Agreement, it sends it to the Customs Union Commission established in accordance with the Agreement on the Customs Union Commission dated October 6, 2007 (hereinafter referred to as the Agreement). - Commission). The Commission, within 60 calendar days from the date of entry into force of this Agreement, forms a consolidated list of goods supplied to third countries for which the legislation of the States of the Parties provides for the application of export customs duties, indicating the rates of these duties (hereinafter referred to as the consolidated list of goods) and sends it to the Parties.
Article 2
The Parties strive to unify the lists of goods and export customs duty rates. The Parties do not unilaterally expand the lists of goods, except in cases that the Parties will determine by a separate agreement.
Article 3
If the goods produced in the territory of the State of one Party applying export customs duties to this product are delivered to a third country from the territory of the State of the other Party not applying export customs duties to this product or applying lower rates of export customs duties, this other Party is obliged to ensure the collection of export customs duties at the rates applicable in the State of the Party in whose territory the goods were produced and indicated in the consolidated list of goods.
Article 4
If one of the Parties makes changes to the lists of goods or the rates of export customs duties in agreement with the Parties or on the basis of an agreement concluded in accordance with Article 2 of this Agreement, this Party shall inform the Commission of the planned and introduced changes. The Commission adjusts the consolidated list of goods and notifies the Parties of the relevant changes to it.
Article 5
Disputes related to the application or interpretation of the provisions of this Agreement are resolved through consultations and negotiations between the Parties, and in case of failure to reach an agreement, they are referred to the Court of the Eurasian Economic Community.
Article 6
By agreement of the Parties, amendments may be made to this Agreement, which are formalized in separate protocols.
Article 7
The procedure for entry into force, accession to and withdrawal from this Agreement shall be determined by Protocol on the procedure for the entry into force of international treaties aimed at forming the legal framework of the Customs Union, withdrawal from them and accession to them dated October 6, 2007.
Done in Moscow on January 25, 2008, in one original copy in the Russian language. The original copy of this Agreement is kept in The Integration Committee of the Eurasian Economic Community, which, as the depositary of this Agreement, will send each Party a certified copy of it.
