On the ratification of the Agreement on the Dissemination of Documents on Interstate Standardization

Agreement on the dissemination of documents on interstate standardization

The Governments of the States Parties to this Agreement, hereinafter referred to as the Parties,
cooperating in the implementation of the provisions of the Agreement on the Implementation of a Coordinated Policy in the Field of Standardization, Metrology and Certification dated March 13, 1992,
considering the economic feasibility of cooperation to ensure the reliability of applicable documents on interstate standardization and the unity of principles of their dissemination,
being interested in the effective work of national standardization bodies,
based on the need to further develop interstate standardization, expand the dissemination and use of documents on interstate standardization,
have agreed on the following:
Article 1
The purpose of this Agreement is to form common principles for the dissemination of documents on interstate standardization adopted by the Interstate Council for Standardization, Metrology and Certification (IGC).
Article 2
For the purposes of this Agreement, these terms have the following meanings:
documents on interstate standardization - interstate standards adopted by the IGS, rules and recommendations on interstate standardization, interstate classifiers of technical, economic and social information and amendments thereto, as well as their translations and drafts;
distribution of documents on interstate standardization - reproduction, copying, translation of documents on interstate standardization for the purpose of their sale or provision in any other way, in printed or electronic form, including as part of collections, databases and data banks, other information resources, including information resources posted on the Internet;
The national standardization body is a nationally recognized standardization body that has the right to represent the interests of the State in the field of standardization in the relevant international or regional standardization organization.
Article 3
The exclusive right to distribute documents on interstate standardization is assigned to national standardization bodies or organizations authorized by them, about which the national standardization bodies inform each other and the Bureau of Standards of the MGS.
Each State Party to this Agreement may have only one national standardization body or its authorized organization responsible for the dissemination of documents on interstate standardization.
National standardization bodies or organizations authorized by them of the States Parties to this Agreement shall inform each other and the MGS Bureau of Standards of the facts of unauthorized dissemination of documents on interstate standardization.
Article 4
The Parties shall ensure protection against unauthorized dissemination of documents on interstate standardization in accordance with the legislation of their States.
Article 5
The conditions for the distribution of documents on interstate standardization and protection against their unauthorized distribution are determined by the procedure for the distribution of documents on interstate standardization, which is developed by the MGS and approved by the Decision of the CIS Economic Council.
Article 6
The coordination of the activities for the implementation of this Agreement is carried out by the Bureau of Standards of the IGS in cooperation with the national standardization authorities of the States Parties to this Agreement.
Article 7
By agreement of the Parties, amendments may be made to this Agreement, which are an integral part of it, which are formalized by the relevant protocol and enter into force in accordance with the procedure provided for in Article 9 of this Agreement.
Article 8
Disputes between the Parties arising from the application and interpretation of this Agreement shall be resolved through consultations and negotiations between the Parties concerned.
Article 9
This Agreement shall enter into force on the date of receipt by the depositary of the third notification that the Signatories have completed the internal procedures necessary for its entry into force.
For the Parties that have completed the internal procedures later, this Agreement shall enter into force from the date of receipt by the depositary of the relevant documents.
Article 10
After its entry into force, this Agreement is open for accession by any State by submitting an instrument of accession to the depositary.
For a CIS member State, this Agreement shall enter into force 30 days after the date of receipt by the depositary of the instrument of accession.
For a non-CIS State, this Agreement shall enter into force 30 days after the date of receipt by the depositary of the last notification of the consent of the signatory or acceding States to such accession.
Article 11
This Agreement is concluded for an indefinite period. Each of the Parties has the right to withdraw from this Agreement by sending a written notification to the depositary of its intention no later than six months before withdrawal and having settled the obligations of the Party under this Agreement that arose during its validity.
Done in Dushanbe on June 1, 2018, in one original copy in the Russian language. The original copy is kept in the Executive Committee of the Commonwealth of Independent States, which will send a certified copy to each signatory State of this Agreement.

I hereby certify that the attached text is an authentic copy of the Agreement on the Dissemination of Documents on Interstate Standardization, signed at the meeting of the Council of Heads of Government of the Commonwealth of Independent States, which took place on June 1, 2018 in the city of Dushanbe. The original copy of the above-mentioned Agreement is kept in the Executive Committee of the Commonwealth of Independent States.
