The Republic of Kazakhstan, on the one hand, and Kingdom of Belgium, Republic of Bulgaria, Czech Republic, Kingdom of Denmark, Federal Republic of Germany, Republic of Estonia, Hellenic Republic, Kingdom of Spain, French Republic, Ireland, Italian Republic, Republic of Cyprus, Republic of Latvia, Republic of Lithuania, Grand Duchy of Luxembourg, Republic of Hungary, Republic of Malta, Kingdom of the Netherlands, Republic of Austria, Republic of Poland, Portuguese Republic, Romania, Republic of Slovenia, Slovak Republic, Republic of Finland, The Kingdom of Sweden, the United Kingdom of Great Britain and Northern Ireland (hereinafter referred to as the "Member States"), represented by the Council of the European Union, the European Community and the European Atomic Energy Community (hereinafter referred to as the "Member States"). - The "Communities") represented by the "Council of the European Union and the European Commission, on the other hand, hereinafter referred to as the "Parties" for the purposes of this Protocol, taking into account the terms of the Treaty between the Kingdom of Belgium, the Czech Republic, the Kingdom of Denmark, the Federal Republic of Germany, the Republic of Estonia, the Hellenic Republic, the Kingdom of Spain, the French Republic, Ireland, Italy Republic of Cyprus, Republic of Latvia, Republic of Lithuania, Grand Duchy of Luxembourg, Republic of Hungary, Republic of Malta, Kingdom of the Netherlands, The Republic of Austria, the Republic of Poland, the Portuguese Republic, the Republic of Slovenia, the Slovak Republic, the Republic of Finland, the Kingdom of Sweden and the United Kingdom of Great Britain and Northern Ireland (member States of the European Union) and the Republic of Bulgaria and Romania on the accession of the Republic of Bulgaria and Romania to the European Union, which was signed in Luxembourg on April 25, 2005 and enters into force effective January 1, 2007, taking into account the new nature of relations between the Republic of Kazakhstan and the European Union, as a result of the accession of two new member States to the EU, which provides new opportunities and challenges for cooperation between the Republic of Kazakhstan and the European Union, in view of the desire of the Parties to ensure the achievement and fulfillment of the objectives and principles of the Partnership and Cooperation Agreement, we have agreed as follows:
Article 1
The Republic of Bulgaria and Romania will join the Partnership and Cooperation Agreement establishing cooperation between the European Communities and their member States, on the one hand, and the Republic of Kazakhstan, on the other hand, signed in Brussels on January 23, 1995 and entered into force on July 1, 1999 (hereinafter - The "Agreement"), and, accordingly, will approve and take into account, in the same way as other Member States, the contents of the Agreement, as well as joint statements, correspondence and declarations of the Republic of Kazakhstan attached to the final act signed on the same day and the protocol to the Agreement dated April 30, 2004, which entered into force on June 1, 2006.
Article 2
This Protocol is an integral part of the Agreement.
Article 3
1. This protocol must be approved by the Communities, the Council of the European Union on behalf of the Member States and the Republic of Kazakhstan in accordance with their internal procedures. 2. The Parties undertake to notify each other of the completion of the relevant procedures mentioned in the previous paragraph. The approval instruments will be kept at the General Secretariat of the Council of the European Union.
Article 4
1. This Protocol shall enter into force on the first day of the first month following the date of submission of the last approval instrument. 2. This Protocol will be temporarily applied from January 1, 2007 until the date of its entry into force.
Article 5
1. The texts of the Agreement, the final act and all documents attached thereto, as well as the Protocols to the Agreement of April 30, 2004, are drawn up in Bulgarian and Romanian. 2. They are attached to this protocol and have the same validity as the texts of the Agreement, the final act and the documents attached thereto, as well as the Protocols to the Agreement of April 30, 2004, executed in other languages.
Article 6
This protocol is drawn up in two copies in Kazakh, Bulgarian, Czech, Danish, Dutch, English, Estonian, Finnish, French, German, Greek, Hungarian, Italian, Latvian, Lithuanian, Maltese, Polish, Portuguese, Romanian, Slovenian, Slovak, Spanish and Swedish, each of which is equally authentic..
