SECURITY AGREEMENT BETWEEN THE REPUBLIC OF KAZAKHSTAN AND THE NORTH ATLANTIC TREATY ORGANIZATION

Recognizing that the Republic of Kazakhstan is a partner country in the North Atlantic Cooperation Council (NCC)/Partnership for Peace (PIM); Having agreed to hold consultations on political and security issues, and to expand and strengthen political and military cooperation in Europe; Realizing that effective cooperation in this area requires the exchange of sensitive and/or privileged information between the parties; Agreed on the following:
Article 1
The parties will:
(i) protect and protect the information and information of the other Party; (ii) do everything necessary to ensure that classified information and information contain the conditions of admission determined by either Party, taking into account the information and information of the other Party, and protect such information and information according to agreed common standards; (iii) not use the information exchanged information and information for purposes not covered by the relevant programmes, as well as decisions and resolutions related to these programmes; (iv) not to provide such information and information to third parties without the consent of the information source.
Article 2
(i) The Government of the Republic of Kazakhstan undertakes to properly issue admission to all its citizens who have access to information and information obtained under the CCAS or PIM in accordance with their professional duties before they have access to such information and information. (ii) Security clearance procedures should be conducted in such a way as to determine whether a person, taking into account his loyalty and reliability, can have access to such information without risking its secrecy.
Article 3
The NATO Security Office (NOS), under the direction and on behalf of the Secretary General and Chairman of the NATO Military Committee, acting on behalf of the North Atlantic Council and the NATO Military Committee and in accordance with their instructions, is responsible for the security and protection of classified information exchanged within the framework of the CCAS/PIM.
Article 4
The Republic of Kazakhstan will inform NOS about national security agencies with similar functions. Separate Administrative Conditions will be developed between the Government of the Republic of Kazakhstan and NATO, which will include, among other things, standards for mutual protection of the security of exchanged information and communication between the authorities of the Republic of Kazakhstan and NOS.
Article 5
Before exchanging any classified information between the Government of the Republic of Kazakhstan and NATO, the responsible security authorities must mutually ensure that the receiving party is ready to ensure the protection of the information it receives, according to the sender's requirements.
In witness whereof, the Representatives mentioned above have signed this Agreement. Signed in duplicate in Brussels on July 31, 1996, in English and French, which are equally authentic.

Appendix 1 to the DEA (94)10
The procedure for issuing passes for representatives appointed by partner countries
1. These procedures will be applicable to official representatives of partner countries appointed by the States participating in the North Atlantic Cooperation Council and/or the PIM.
I. Access to objects
2. Designated representatives of the partner countries and service personnel will be issued passes of the established pattern. 3. The pass, which will contain information about the owner (full name, nationality, validity period of the pass and photo), will be valid for one year; after sending a corresponding request, it can be extended. The pass provides access to non-secret areas of the facility. When accessing protected areas, the pass holder is treated as a visitor. When visiting protected areas, a representative of the partners must be accompanied. A representative with a permanent NATO pass, to whom the visitor arrived, is responsible for escorting from the duty room. The duty rooms are located at the main entrance and at the northern entrances to the corridor "K". Holders of passes issued to representatives of partners have the right to guide visitors only to their offices and certain office premises (Na and Nb).
II. Procedures
4. To receive passes, you must submit a biography to the Executive Secretariat. Service personnel who have not provided this information should fill out the attached form, which can be obtained from the Executive Secretariat. After all the above is completed, the Executive Secretariat will inform the partner representatives of the need to arrive at the duty room in the lobby of the main entrance of the NATO headquarters to complete the prescribed formalities, such as photographing and issuing passes. The liaison officers will need to replace their existing passes with new ones.

Requirements for the content of a biography for permanent SSAS liaison officers/PYM
1. Partner countries appointing their representatives and support staff should provide the Executive Secretariat with their names and full biographies in order to begin the process of reviewing and issuing permits. Partner country officials do not need to send their biographies in order to obtain a NATO pass, if they have already sent them.
2. The biography must contain: (a) personal information (including spouse and children, if applicable): full name (patronymic, if applicable), date and place of birth; (b) education; (c) military service (if any); (d) detailed description of jobs (past positions/appointments, ranks and titles), including language proficiency.

Code of Conduct
Considering: - that, as part of the activities of the North Atlantic Cooperation Council/the PIM program, the North Atlantic Council invited partner countries to participate in political and military bodies at NATO headquarters and a separate Partnership Coordination Center located in the city of Mons; and - that the North Atlantic Council has requested partner countries to commit themselves that they will not use NATO facilities and facilities for activities incompatible with the principles of cooperation underlying the partnership and/or detrimental to the national interests of the Alliance's member countries.

Security Agreement between the North Atlantic Treaty Organization and the countries participating in the North Atlantic Cooperation Council and/or the Partnership for Peace program
The North Atlantic Treaty Organization (NATO) and [country name] as a partner country in the North Atlantic Cooperation Council (NCC)/Partnership for Peace program, Having agreed to hold consultations on political and security issues, and to expand and strengthen political and military cooperation in Europe; Realizing that effective cooperation in this area requires the exchange of sensitive and/or privileged information between the parties;
1. Agreed on the following:

Appendix 5 to the DEA(94) 10
Minimum standards for the processing and protection of information exchanged under the CCAS and PIM programs
General provisions.
1. All information exchanged between the parties within the framework of the CCAS/PIM programs is information of limited access and for official use only. Therefore, it will be distributed only to organizations and individuals who participate in these programs and need it due to their activities.
The degree of secrecy.
2. The degree of secrecy will be used to indicate the degree of confidentiality of information and, therefore, to ensure procedures and measures that will be applied to protect it. It is the prerogative of the author of the document to establish the degree of secrecy of the document, to lower the degree of its secrecy, or to declassify it. 3. The following degrees of secrecy have been established: UNCLASSIFIED, RESTRICTED ACCESS, CONFIDENTIAL AND SECRET. When the security label is indicated, the CCAS and/or PIM designation is placed in front of it to indicate the program through which information is exchanged. 4. If NATO or a partner country wishes to restrict the dissemination of certain information, this will be indicated in a separate line at the bottom after specifying the secrecy label - "NATO"/"only [name of the partner country]"; for example: PIM - CONFIDENTIAL POLAND/NATO ONLY
Requirements for processing, storing, and transmitting information.
5. Documents (information) marked "UNCLASSIFIED" are treated as official information, but they do not require special protection. They can be sent by regular mail or transmitted via conventional telecommunication systems. The recipient can reproduce the documents if necessary. Documents (information) marked with "RESTRICTED ACCESS" are processed and stored in premises where access to unauthorized persons is prohibited. "RESTRICTED ACCESS" documents can be sent by registered mail via regular mail. If special protective measures cannot be taken and the information needs to be transmitted immediately, it can be transmitted using a regular fax or telex. The recipient can reproduce the documents if necessary. Documents (information) marked "CONFIDENTIAL" are processed and stored in premises where access is controlled. Access to the information will be allowed only for certain persons who have passed a special check and have appropriate access to this information and materials by virtue of their official duties. Documents marked "CONFIDENTIAL" are stored in containers with secure locks, the keys or code combinations of which are in the possession of specially designated security personnel. Documents marked "CONFIDENTIAL" are sent by diplomatic mail or courier mail. Electronic information transmission channels marked "CONFIDENTIAL" must be equipped with a cryptographic system certified by the relevant authorized body. These documents can be reproduced by a specially designated person in the receiving organization.; the credentials must specify the number of copies and their storage. Documents (information) marked "SECRET" are processed and stored in premises, access to which is controlled and limited by a circle of specially appointed persons who have passed a special check. Access to the information will be allowed only for certain persons who have passed a special check and have appropriate access to this information and materials by virtue of their official duties. Documents marked "SECRET" are stored in safes with secure locks, the keys or code combinations of which are in the possession of specially designated security personnel. Documents marked "SECRET" are sent by diplomatic mail or courier mail. Electronic information transmission channels marked "SECRET" must be equipped with a cryptographic system certified by the relevant authorized body. These documents can only be reproduced with the written permission of a specially designated security officer, and the number of copies and their storage must be indicated in the credentials.
Security department (office) and document control.
6. A security department (office) should be established in each organization to receive, transfer, control and store documents and information exchanged between the parties under the CCAS/PIM programs. In large organizations, additional subordinate security departments can be created, if necessary. The security department or subordinate security department is responsible for: - registration of cards of all documents; - distribution of documents within the organization; - sending documents developed in this organization; - storage of documents related to CCAS/PIM programs; - destruction of documents, including drawing up an act of destruction.
Verification of trustworthiness and access to information.
7. Before allowing a person to access information marked "CONFIDENTIAL" OR "SECRET", a security check must be carried out in order to establish his loyalty and the possibility of trust in him. If the verification result is positive, an admission form is issued by the relevant competent authority.
8. Before being admitted to classified information, a person must be familiar with the rules for handling information of the appropriate security classification and the legal and disciplinary consequences of violating these rules.
9. When instructing a person with an admission form to represent his organization at a meeting where classified information will be discussed, or if the meeting will be held in a secure room, the organization must first send a certificate of the form of admission of this person to the organization holding the meeting.
Violations of the secrecy regime.
10. If information classified as "CONFIDENTIAL" or "CLASSIFIED" is violated, the relevant security authority should conduct an investigation into the circumstances of the violation in order to determine whether classified information has been leaked.
11. If a leak has occurred, the developer of the document is informed about it and an assessment of the damage is carried out. The developer may propose or initiate measures to minimize the damage.
12. The organization in which the security violation occurred must take measures to eliminate deficiencies or improve the procedures or storage facilities that could cause a security violation.
Appendix 6 to the DEA (94)10
Administrative arrangements for the implementation of the Security Agreement between the North Atlantic Treaty Organization and the member countries of the CCC and the PIM
1. In accordance with the provisions of paragraph 5 of the Security Agreement, the NATO Security Office (DEA) and the responsible departments of the partner country dealing with information security issues must mutually ensure that the receiving party is ready to protect the information it receives in accordance with the requirements of the sending party.
2. Each participating non-NATO State or organization will identify the agency that will be responsible for implementing the security arrangements and procedures under the Security Agreement, and will indicate this agency to the NATO Security Office, which will be the equivalent of the Information Security office in NATO, as provided for in this document.
3. The NATO Security Office, with the assistance, where necessary, of national security agencies or their representatives from NATO member countries, will establish cooperation with the security agencies of non-NATO States or organizations in order to facilitate the mutual implementation of security measures designed to protect the exchanged information.
4. In accordance with the minimum standards contained in Annex 5, which follow from the NATO Security Regulations, administrative arrangements will address the following issues: (a) partner country agencies responsible for information security, which will implement and monitor security measures to protect classified information exchanged under the CCAS/PIM programs; (b) the organization of the partner country, which will be the main recipient of classified information (Central Office (Security Department); (c) other organizations in the partner country that have the right to correspond directly with NATO organizations (subordinate departments (offices)); (d) channels for transmitting classified and unclassified documents; (e) procedures for recording and controlling documents; (f) standards for safes used to store classified documents; (g) procedures for personnel inspections, and (h) investigations of safety violations.
5. After signing the Security Agreement and before exchanging classified information, the NATO Security Office will conduct, and the host country or organization may conduct, an inspection of the degree of readiness of the organization or the host country or, respectively, NATO for the proper handling and storage of classified information to be exchanged. The reports of the NATO Security Office on the inspections carried out will be transmitted to the Secretary General, who, in turn, will inform the North Atlantic Council, if necessary.
6. NATO and each cooperating country or organization will exchange addresses that will be used to send documents, as well as information about courier or courier services for the transmission of classified and unclassified information.
