The Zhitikarinsky District Court of the Kostanay region is conducting a civil case on the claim of I.A.N. to me about the division of the spouses' property. I have good reasons to believe that the plaintiff's arguments are untrue, we did not jointly acquire any common property in the form of funds under the bank loan agreement, and I did not give consent to receive bank loans to the plaintiff. The plaintiff spent all the money on personal needs, namely on the purchase of an apartment at the address: g. Gitikara, . and its repair, as well as for the purchase of a VAZ-21014 car with registration in the Russian Federation. In accordance with part 4 of Article 73 of the Civil Procedure Code of the Republic of Kazakhstan, "In the event that the presentation of evidence is difficult for the parties and other persons involved in the case, the court of first instance, at their request, assists them in obtaining evidence." Also, the plaintiff did not provide the court with a transcript / certificate of bank loan agreements showing the amount of debt, interest on the use of funds, as well as the amount of penalties.

Since I am unable to provide the court with evidence confirming my arguments about the plaintiff's acquisition of real estate, since I was not a party to the purchase and sale transaction, and also cannot provide information about the registration of a car in the name of the plaintiff in the Republic of Kazakhstan of a car registered in the Russian Federation, I ask: - to claim the NAO "State Corporation "Government for citizens" in Kostanay region" registration file for real estate located at the address: g. Gitikara, ..; - oblige the plaintiff to provide the court with the history of insurance of civil liability of the vehicle owner; - oblige the plaintiff to provide the court with a certificate from JSC Kaspibank, JSC Halyk Bank of Kazakhstan with a transcript of the loan information – information on the repayment date of the loan, the amount of the principal debt, the amount of interest on the loan, the amount of penalties and fines.
