In the proceedings of the OP at the UP of the Auezovsky district of Almaty, a criminal case is being investigated registered in the ERDR No. 217540031001365 on the grounds of a criminal offense provided for in art.188 Part 1 of the Criminal Code of the Republic of Kazakhstan in relation to B.K. On November 5, 2021, the Investigator of the ML OP at the UP of the Auezovsky district, Police Lieutenant B.M.M., having reviewed the materials registered in the ERDR No. 217540031001365 on the grounds of a criminal offense under art.188 Part 1 of the Criminal Code of the Republic of Kazakhstan, the Investigator decided to appoint a forensic economic examination in this criminal case, which she will entrust to the experts of the ISE of Almaty. On December 3, 2021, Deputy Prosecutor of the Auezovsky district Almaty Zh.E., studied the materials of the pre-trial investigation No. 217540031001365, where he established the need to appoint a second forensic economic examination.

Accordingly, for the purpose of a comprehensive, complete and objective consideration of a criminal case, within the framework of a forensic economic study, the following tasks should be set before the expert::
establishment of registration, accrual, payment and write-off of funds;
determining the compliance of accounting with the requirements of accounting legislation;
research of cash transactions at cash desks and bank accounts;
research of other accounting operations relevant to the case.
According to Article 274 of the Criminal Procedure Code of the Republic of Kazakhstan, which stipulates that when appointing an expert examination and conducting it, the victim, the suspect, the accused, the defender and the victim's representative have the right:
Before conducting the examination, they should get acquainted with the decision on its appointment and receive an explanation of their rights, about which a protocol is drawn up.;
request additional questions to be asked or clarified by the expert.
The listed rights are also enjoyed by a witness, including one who has the right to defense and has been subjected to an expert examination. According to Article 272, Part 4 of the Criminal Procedure Code of the Republic of Kazakhstan, which states that the person who appointed the examination introduces the decision on the appointment of a forensic examination of the suspect, the accused, his defender, the victim, his representative, as well as the witness undergoing the examination, including those entitled to protection, his legal representative and explains to them the rights provided for in Article 274 of this Code. A protocol is drawn up on this, signed by the person who appointed the examination and the persons who are familiar with the resolution. According to Article 99 of the Criminal Procedure Code of the Republic of Kazakhstan, participants in criminal proceedings have the right to apply to the person conducting the pre-trial investigation, the prosecutor, the judge (to the court) with petitions for procedural actions or procedural decisions to establish the circumstances relevant during the criminal process, to ensure the rights and legitimate interests of the person who filed the petition, or represented by them faces.

In accordance with Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan, the investigator and the inquirer are obliged to take all measures provided by law for a comprehensive, complete and objective investigation of the circumstances necessary and sufficient for the proper resolution of the case.
