The petition
about familiarization with the materials of the criminal case
The interdepartmental investigative task force of the Prosecutor General's Office of the Republic of Kazakhstan (hereinafter referred to as the ICOG GP RK) is investigating criminal case No. 220088011000003, registered with the ERDR on grounds of a criminal offense under Article 255, Part 4 of the Criminal Code of the Republic of Kazakhstan. On January 06, 2022, the Special Prosecutors Service launched a pre-trial investigation No. 220088011000003 on this fact under art. 255 part 4 of the Criminal Code of the Republic of Kazakhstan. (Act of terrorism) Thus, during the investigation of this criminal case, it was established that one of the persons involved in the mass riots is K.A.T., born on 05/26/1977, who was born on 04/09/2022. He was detained in accordance with Article 131 of the Criminal Procedure Code of the Republic of Kazakhstan and placed in an IVS in the city of Almaty. On 04/11/2022, the acts of the suspect K.A.T. were qualified under art.272 part 2 of the Criminal Code of the Republic of Kazakhstan. (Mass riots)
Request for familiarization with the materials of the pre-trial investigation
The pre-trial investigation of the present criminal case was entrusted to the investigator of the SU of the National Security Committee of the Republic of Kazakhstan in Almaty, Captain of National Security Mukhamedzhanov A.B. In accordance with art. 64, paragraph 9. of the Criminal Procedure Code of the Republic of Kazakhstan, the suspect has the right to: receive copies of the decisions on recognition as a suspect, the protocol of interrogation of the qualification of the act, the protocol of detention, the petition and the resolution on the election and extension of the preventive measure. Article 99 of the CPC of the Republic of Kazakhstan provides that Participants in criminal proceedings have the right to apply to the person conducting the pre-trial investigation with requests for procedural actions or making procedural decisions to establish circumstances relevant during the criminal process, to ensure the rights and legitimate interests of the person who filed the petition or the person they represent.
The application is subject to review and resolution immediately after its application. In cases where an immediate decision on the application is not possible, it must be resolved no later than three days from the date of the application. In accordance with Article 24 of the Criminal Procedure Code of the Republic of Kazakhstan, the investigator and the inquirer are obliged to take all measures provided by law for a comprehensive, complete and objective investigation of the circumstances necessary and sufficient for the proper resolution of the case. On the basis of the above and in accordance with Articles 24, 64 and 99 of the Criminal Procedure Code of the Republic of Kazakhstan,
I ask you to:
Acceptance of the materials of the pre-trial investigation into production;
Creation of an investigative, investigative and operational group;
Establishing the language of judicial proceedings in a criminal case;
Provide copies of the decision on recognition as a suspect;
Qualifications of the suspect's act;
Initiation of a petition for the authorization of a preventive measure;
Resolution on the involvement of a specialist to give an opinion;
Resolution on the appointment of a forensic examination;
Resolution on the seizure of property;
To familiarize with the interrogation protocols;
Provide copies of the detention report;
The results of consideration of complaints, petitions of the defense;
Conducting searches and seizures (after their completion);
Conducting an investigative experiment;
Obtaining samples for expert examination.
To familiarize with the protocols of other investigative actions carried out with the participation of the suspect;
To respond to the application within the time limits prescribed by law.
