MOTION
for obtaining information on the progress of the criminal case
A criminal case based on the materials of the pre-trial investigation under ERDR No. 257123031001142 is being investigated by the Investigative Department of the Police Department of Astana, by the Head of the Department, Khosherbayev S.T., following a statement submitted to the “Nura” District Police Department of the Police Department of Astana by citizens of the Republic of Kazakhstan requesting that the executives of the construction company LLP “Asyl-Nur Qurylys” be brought to criminal liability.
The said executives, by deceiving residents and abusing their trust, despite having no right to attract funds from equity holders for the construction of the residential complex “Mardan”, located at the intersection of Ch. Aitmatov Street and E-164 Street, Astana, unlawfully obtained funds in an especially large amount, thereby causing significant material damage.
On 22 May 2025, this fact was registered in the ERDR under No. 257123031001142 pursuant to Article 190, Part 4, Paragraph 2 of the Criminal Code of the Republic of Kazakhstan.
With respect to pre-trial investigation No. 257123031001142, pursuant to Article 294 of the Criminal Procedure Code of the Republic of Kazakhstan (Notification of the completion of investigative actions and explanation of the right to review the materials of the criminal case), the completion of the pre-trial investigation was announced on 13 January 2025.
Pursuant to Article 99 of the Criminal Procedure Code of the Republic of Kazakhstan, participants in criminal proceedings have the right to submit motions to the person conducting the pre-trial investigation, the prosecutor, or the judge (court) concerning the performance of procedural actions or the adoption of procedural decisions for the purpose of establishing circumstances relevant to the criminal proceedings and ensuring the rights and legitimate interests of the person submitting the motion or the person represented by them.
Based on the foregoing and pursuant to Articles 70 and 99 of the Criminal Procedure Code of the Republic of Kazakhstan,
I REQUEST THAT YOU:
· Provide information on the progress of criminal case No. 257123031001142, indicating all types of records/cards maintained in relation to the criminal case.
