Application

(On a criminal offense)

         On 07.01.2022, when my acquaintance Yerkebulan and I left for the village, in the village of Uzynagash, Almaty region, police officers detained me on suspicion of theft.

On the same day, I was caught by police officers and put me in a truck. In said truck, I fell to the ground with my stomach and began to hit me on the head and body. Then we were brought to the police headquarters in Kaskelen, Almaty region, or Uzynagash, and brought into the office and began to beat me with a policeman's hand. He hit me in the ribs with his hand. I don't remember exactly how many times he was beaten. The next day he was taken to the police department of Almaty.

I was brought to the police department on 09.01.2022 at about 12:00 noon and brought me to the 4th floor. At this point, I was beaten by police officers. Then I was put in a temporary detention center. On 01/10/2022, I was taken to the investigator's office for interrogation. The investigator was sitting on the 5th floor of the building. It was then that they began to interrogate me, and I told them what had happened. However, what I said did not please the police officers. Then they took me to the 4th floor, beat me with their hands from my body to my feet, tortured me and confessed to the crime of theft, which I did not commit. I felt bad from the physical injuries I received, my eyes were staring and my body ached. Then I was brought into the investigator's Office, identified as a suspect, interrogated as a suspect in the presence of a lawyer, and confessed to a crime of theft, which I did not commit out of fear of police officers. Then I was locked up in a temporary detention center. A few days later, online, I was sanctioned by the investigative court for the application of a restraining order on custody.

By a court order, I was placed in a pre-trial detention center for 2 months. Then I was taken to LA-155/18. On 21.01.2022, by the decision of the judicial board for criminal cases of the Almaty city court, a bail restraining order was applied against me. After leaving the pre-trial detention center, I had to apply to a medical institution after severe pain in my body and head. As a result, it turned out that I had broken ribs, physical injuries to the chest, head, left thigh. In accordance with Article 146 of the Criminal Code of the Republic of Kazakhstan, the investigator shall be punished by another official for obtaining or confessing information from the torturer or for an act committed or suspected of committing by him or another person. According to Article 179 of the Code of Criminal Procedure of the Republic of Kazakhstan, the beginning of the pre-trial investigation is the registration of an application, a message about a criminal offense in the Unified Register of pre-trial investigations or the first urgent investigative action. Based on the above, in accordance with Article 179 of the Criminal Code of the Republic of Kazakhstan,
