Application
on issuing a court order to recover alimony
On May 13, 2010, ka Abdukhalievna (hereinafter referred to as the plaintiff) and B N Auuly (hereinafter referred to as the defendant) entered into a legal marriage. There are minor children from a common marriage. They are:
* Arsen N, born on 11.10.2010, IIN ....;
* Born on 08.07.2014 in Almaty, IIN .....
Article 30 of the Code of the Republic of Kazakhstan on marriage (matrimony) and family provides that the corresponding spouses enjoy equal rights and perform equal duties. Spouses are obliged to build their relations in the family on the basis of mutual respect and mutual assistance, contribute to the well-being and strengthening of the family, take care of the health, development of their children and their well-being.
The defendant does not provide material assistance to the fireman of his own free will.
As specified in Article 70 of the Code of the Republic of Kazakhstan on marriage (matrimony) and family, it provides and undertakes that parents are obliged to take care of the health of their child and raise their child, as well as are responsible for providing the necessary living conditions for his physical, mental, moral and spiritual development.
Unfortunately, the defendant lives his own life, all the funds earned by the defendant are spent on unknown needs separately from the family.
All family expenses fall on the shoulders of the applicant. The applicant has already applied to the court with a claim for divorce.
Currently, minor children live with their mother. Despite this, the defendant voluntarily does not provide material assistance in the maintenance of minor children, evades the performance of parental duties.
Article 139 of the code of marriage (matrimony) and family, in the absence of an agreement on the payment of alimony, the court shall collect alimony for minor children from their parents monthly in the following amounts: for one child-a quarter of the parent's income and (or) other income; for two children-a third; half equal to three or more children.
Based on the above, guided by articles 138-140 of the Code of the Republic of Kazakhstan "on marriage (matrimony) and family", articles 140,145-147 of the Civil Code of the Republic of Kazakhstan,

- Born on 08.07.2014, IIN .... to issue a court order on recovery of alimony in the amount of 3/1 of all income of the defendant in favor of the applicant Ka Abdukhalievna for adoption until the age of majority;
* All expenses for the recovery of alimony in accordance with the norms of the Civil Code of the Republic of Kazakhstan are assigned to the defendant.
