Statement
On January 23, 2017, at about 7.30 p.m., an unidentified person, located at 37 Timiryazeva St., Almaty, particularly audaciously violating public order for hooligan motives, inflicted bodily injuries with the use of firearms, thereby causing physical harm to the health of gr. Ts.A.L.. Criminal case No. 177500031000220 dated January 23, 2017 was initiated in this case, and the police are currently conducting investigative actions to identify and detain the offender.
The idea of taking measures to eliminate the circumstances of violations of the law
However, the victim, Ts.A.L., after being discharged from the hospital, establishes that, to this day, since the armed attack on Ts.A.L., the management company of the house, LLP "Housing and Communal Services Servise" located at 37 T. Street, has not eliminated those circumstances, namely:
Full parking lighting;
Installation of video surveillance cameras throughout the parking lot;
Guards increase from one to the required three;
The victims and other residents of the house are paying in full for the above-mentioned imaginary services to date, and previously the parking lot was only partially illuminated and there are no video surveillance cameras, one guard is sitting in place of the three guards. Compared to the neighboring parking lot, which is serviced by the same management company, Housing and Communal Services Servise LLP, the parking lot is fully equipped with light and video surveillance cameras are installed. However, the confidence of the impunity of the management companies of the house, Housing and Communal Services Servise LLP, has not yet installed full lighting, video surveillance throughout the parking lot and has not increased the number of three guards assigned to one place.
After such an offense involving the use of firearms, the concerns of the residents of the house and the victim have not died out and intend to take all legally established measures to eliminate the circumstances of violations of the law and restore public order and tranquility for a comfortable stay in this house. We believe that the management company of the house, Housing and Communal Services Servise LLP, through its negligence in its functional duties, contributed to the commission of a criminal offense and other violations of the law in this house, due to which the police still cannot identify and detain the perpetrator. According to the Criminal Procedure Code of the Republic of Kazakhstan, Article 200. Having established in the course of criminal proceedings the circumstances that contributed to the commission of a criminal offense, the person conducting the pre-trial investigation has the right to submit to the relevant state bodies, organizations or persons performing managerial functions in them an idea of taking measures to eliminate these circumstances or other violations of the law. Submissions are subject to review with mandatory notification of the measures taken within one month. Also, the Code of the Republic of Kazakhstan on Administrative Offenses, article 479, provides that failure by the head of the organization and other persons to report on the measures taken to eliminate the causes and conditions conducive to the commission of crimes or administrative offenses, according to the representations of the authorities (officials) who considered the case, entails a fine in the amount of ten monthly calculation indices. Based on the above and guided by art. 200 of the Criminal Code of the Republic of Kazakhstan, art. 479 of the Administrative Code of the Republic of Kazakhstan, I ask you:
To make and send an idea of taking measures to eliminate the circumstances of violations of the law, namely: Full lighting of the parking lot, Installation of video surveillance cameras throughout the parking lot, Increases in security guards from one to the required three.
To respond to the application within the prescribed time limits.
