Article 100. Bidding conditions The Law on State Property

     1. The person who offered the highest price is recognized as the winner of the auction or tender.

     At auctions, proposals are announced publicly, at tenders, proposals are announced in a closed envelope.

     In the case of the sale of state-owned enterprises as property complexes, shares (shares in the authorized capital) of joint-stock companies (limited liability partnerships) in the authorized capital of which the controlling stake (share in the authorized capital) belongs to the state, the condition of the tender is to preserve the profile of the activity.           - Excluded by the Law of the Republic of Kazakhstan dated June 24, 2025 No. 196-VIII SAM 

     The period of preservation of the profile of the activity of state-owned enterprises, joint-stock companies (limited liability companies), in the authorized capital of which the controlling stake (share of participation in the authorized capital) belongs to the state, is determined by the seller.           - Excluded by the Law of the Republic of Kazakhstan dated June 24, 2025 No. 196-VIII SAM 

     The auction and tender are conducted using the web portal of the Register of State Property in electronic form, with the exception of closed tenders or auctions for the sale of unused weapons and military equipment.

    2. The bidding must be open. The procedure for the sale of privatisation facilities is established by the Government of the Republic of Kazakhstan.

     3. Auctions in which only one participant participated are considered valid if the participant confirmed the starting or announced price.

     Tenders in which only one participant participated are considered valid if the participant offered a price not less than the starting price..

     4. Prior to the bidding, the buyer has the right to check the environmental condition of the object he is acquiring.
