1. The Customer has the right:

1) to monitor the progress and quality of contract work performed by the contractor (general contractor) and compliance with the deadlines for their completion;

2) not to accept from the contractor contract works performed in violation of the requirements stipulated by the construction contract, construction project, state (interstate) regulatory documents, and other requirements stipulated by regulatory legal acts of the Republic of Kazakhstan;

3) monitor the activities of persons engaged in technical supervision and author support, or an accredited legal entity providing engineering services for project management;

4) refuse to receive relevant documents from persons performing technical supervision and author support, or an accredited legal entity providing engineering services for project management, if inconsistencies are identified in them.;

5) when submitting a notification of the start of construction and installation work, submit a schedule of visits to the construction site for the construction period through a portal and digital systems for organizing construction on the "one-stop shop" principle.

The schedule of visits to the construction site for the construction period is subject to coordination with the local executive body of the region, the city of republican significance, the capital, which carries out state architectural and construction control and supervision.

The procedure for approval, the form of the schedule of visits to the construction site for the construction period are approved by the authorized body for architecture, urban Planning and construction;

6) exercise other rights in accordance with the laws of the Republic of Kazakhstan.

2. The Customer is obliged to:

1) before the start of the contract work, transfer the approved design and estimate documentation to the contractor (general contractor);

2) provide the construction site with all necessary permits provided for by the legislation of the Republic of Kazakhstan;

3) ensure the construction of a construction facility with the participation of technical supervision and author's support or an accredited legal entity providing engineering services for project management;

4) take measures against the contractor (general contractor) for non-fulfillment or late and poor-quality execution of instructions from persons carrying out technical supervision and author support, or an accredited legal entity providing engineering services for project management;

5) provide working conditions for persons engaged in technical supervision and author support, or project management;

6) ensure the fulfillment of the instructions of the state control and supervision bodies;

7) provide access to the construction site for officials carrying out state architectural and construction control and supervision, to monitor the activities of persons carrying out technical supervision and author support, or an accredited legal entity providing engineering services for project management;

8) submit to the state body carrying out state architectural and construction control and supervision, for review, design and executive technical documentation or other documents on the construction site;

9) within three working days from the date of approval of the act of acceptance of the construction object into operation, send to the State Corporation "Government for Citizens" at the location of the construction object the approved act of acceptance of the construction object into operation with the attachment to it of the technical characteristics of the construction object, the executive geodetic survey of the actual position of engineering networks and (or) construction objects, declarations of conformity and conclusions on the quality of construction and installation work and the conformity of the work performed with the approved construction project in accordance with the forms developed and approved by the authorized body for architecture, urban Planning and construction, and conclusions on the conformity of the facility with fire safety requirements;

10) to register the condominium of an apartment building put into operation, with the mandatory compilation of an inventory of the common property of the condominium of an apartment building in accordance with the Law of the Republic of Kazakhstan "On Housing Relations";

11) before the sale of apartments, non-residential premises, parking spaces, storerooms of an apartment building into individual (separate) ownership, ensure the state registration of an apartment building;

12) within six months from the date of registration of the construction site, put into operation, to ensure the gratuitous transfer of external engineering networks and structures of the construction site to communal ownership in accordance with the design and estimate documentation;

13) at its own expense, ensure that the land plot is included in the common property of a condominium apartment building or in the common property of a construction facility in accordance with the legislation of the Republic of Kazakhstan;

14) ensure registration of pre-design and design documentation, as well as engineering survey materials (topographic survey of urban development projects, topographic survey at the design stage and executive geodetic survey at the stage of acceptance of a construction site into operation) in the automated digital system of the state urban cadastre;

15) perform other duties stipulated by the laws of the Republic of Kazakhstan.
