Article 124-6. The competence of the authorized body responsible for the management of natural monopolies in the field of socially significant markets of the Entrepreneurial Code of the Republic of Kazakhstan

The authorized body responsible for the management of natural monopolies:

1) develops proposals for the formation of public policy in socially significant markets;

2) carries out state regulation of prices and state control over compliance with the pricing procedure and duties of a socially significant market entity;

3) develops and approves pricing rules in socially significant markets;

4) monitors the prices of subjects of socially significant markets;

5) coordinates marginal prices for goods (works, services) sold by subjects of socially significant markets;

5-1) reduces marginal prices for goods (works, services) sold by subjects of socially significant markets in the amount of income received in connection with:

failure to implement the investment program measures included in the marginal prices;

non-use of funds for the purchase and (or) transfer of electric energy, commercial gas, accounted for in marginal prices;

excess consumption of goods (works, services), including by individual groups of consumers included in marginal prices;

exceeding the marginal price of goods (works, services) agreed upon by the authorized body responsible for the management of natural monopolies;

6) holds public hearings when considering notifications from subjects of socially significant markets about upcoming price increases for goods (works, services);

7) submits mandatory instructions to the subject of a socially significant market on the fulfillment of obligations stipulated by this Code.;

8) in case of non-fulfillment by a subject of a socially significant market of a prescription, submits a claim to the court for forcing a subject of a socially significant market to commit the actions specified in the prescription.;

9) initiates and considers cases of administrative offenses, as well as imposes administrative penalties in accordance with the procedure established by the Code of the Republic of Kazakhstan on Administrative Offenses; - Excluded by the Law of the Republic of Kazakhstan dated July 17, 2025 No. 213-VIII SAM

10) requests and receives information necessary for the exercise of its powers from subjects of socially significant markets in compliance with the requirements established by legislative acts of the Republic of Kazakhstan for the disclosure of information constituting commercial and other legally protected secrets.;

10-1) Was valid until 01.01.2022 by the Law of the Republic of Kazakhstan dated 27.12.2019 No. 295-VI.

10-2) develops and approves the rules for calculating and paying the temporary balancing fee provided for by the legislation of the Republic of Kazakhstan on railway transport, in coordination with the central executive body responsible for the management of railway transport;

10-3) develops and approves regulatory legal acts in the field of natural monopolies in accordance with the objectives of this Code and the legislation of the Republic of Kazakhstan

11) exercise other powers provided for by this Code, the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
