Article 13. The procedure for using the analogy of law and the analogy of law The Law on Legal Acts

     1. In the absence of legal norms governing specific social relations, the analogy of law or the analogy of law may be applied.

     2. In the absence of legal norms governing specific public relations, the analogy of the law is applied.

      3. If it is impossible to use the analogy of law in the cases provided for in paragraph 2 of this article, the analogy of law shall be used.

     4. In the process of applying the analogy of law and the analogy of law, it is not allowed to establish new duties or restrict the rights of individuals or legal entities.

     The possibility of applying the analogy of law and the analogy of law in relations regulated by specific branches of legislation is determined by the relevant legislative acts.

     This Law regulates public relations related to the procedure for the development, submission, discussion, adoption, registration, enactment, amendment, addition, termination, suspension and publication of legal acts of the Republic of Kazakhstan.
