Article 32. Identification of persons who consume narcotic drugs, psychotropic substances, their analogues of the Law on Narcotic Drugs, Psychotropic Substances, Their Analogues and Precursors and measures to counteract their illicit trafficking and abuse

1. A person in respect of whom the internal affairs bodies and other authorized state bodies or health authorities of the Republic of Kazakhstan have received information from organizations or individual citizens that he is illegally consuming narcotic drugs, psychotropic substances, their analogues or is in a state of drug intoxication, is subject to medical examination.

2. The fact of illegal consumption of narcotic drugs, psychotropic substances, and their analogues is established on the basis of witness testimony, as well as if there are signs of drug intoxication and the results of a medical examination, as well as tests for the content of narcotic drugs, psychotropic substances, and their analogues in the body of the person being examined.

3. The establishment of the fact of drug intoxication due to the illegal consumption of narcotic drugs, psychotropic substances, and their analogues is the competence of a doctor who is responsible for conducting a medical examination (examination), and the diagnosis of "mental, behavioral disorder (disease) associated with the use of psychoactive substances" is established by a medical advisory commission.

4. The procedure for identifying and registering persons who illegally consume narcotic drugs, psychotropic substances, and their analogues is determined by regulatory legal acts of authorized bodies regulating healthcare, internal affairs, and other authorized bodies of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated July 10, 1998 No. 279.

This Law regulates the legal basis of state policy in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors and establishes measures to counteract their illicit trafficking in order to provide drug treatment and protect the health of citizens, public and state security.
