1. The acceptance of construction projects into operation is regulated by this Code and the Civil Code of the Republic of Kazakhstan.

2. The acceptance and commissioning of the construction site is carried out by the customer when it is fully ready in accordance with the approved construction project and there is a declaration of conformity, conclusions on the quality of construction and installation work, on the compliance of the completed works with the construction project and the compliance of the construction site with fire safety requirements.

The conclusion on the quality of construction and installation work must be coordinated with the local executive body of the region, the city of republican significance, the capital, which carries out state architectural and construction control and supervision, in accordance with the procedure determined by the authorized body for architecture, urban planning and construction.

Upon expiration of the established deadline for the commissioning of the construction site, the cost of maintaining the construction site is borne by the customer.

At the same time, the complete readiness of the construction site is determined in accordance with the rules for the organization of construction and the passage of licensing procedures in the field of construction.

In certain cases stipulated by Article 133 of this Code, the acceptance of a construction object into operation is carried out by the owner (customer, investor) independently.

3. The commissioning of completed road works for the construction of fiber-optic communication lines is carried out by the customer for the construction of fiber-optic communication lines along highways when they are fully ready and is carried out in accordance with the legislation of the Republic of Kazakhstan.

4. Acceptance and commissioning of construction projects under construction are not allowed.

5. The commissioning of construction projects under construction is allowed in terms of completed construction stages (including launch complexes and stages) in accordance with the legislation of the Republic of Kazakhstan.

6. The acceptance of a construction object into operation is formalized by the act of acceptance of the construction object into operation. The acceptance certificate of the construction site is subject to approval.

The approval of the acceptance certificate for the construction site is carried out by the customer. The date of signing the acceptance certificate for the construction site is considered to be the date of its approval and the date of commissioning of the construction site.

7. The certificate of acceptance of the construction object into operation is signed by the customer, the contractor (general contractor), the persons responsible for project management, technical supervision and author's support, on the basis of the declaration of conformity and conclusions on the conformity of the completed works to the construction project and the quality of construction and installation work.

In case of acceptance of a construction object into operation with violations and (or) deficiencies (defects and imperfections), the participants in the acceptance of the construction object into operation are liable in accordance with the laws of the Republic of Kazakhstan.

8. The responsibilities of the participants in the commissioning of the construction site include:

1) establishment and documentary confirmation of the readiness of the construction site for operation;

2) assessment of compliance of completed construction and installation works and installed technological, engineering or other equipment with design and estimate documentation approved in accordance with the established procedure, regulatory requirements (conditions, restrictions);

3) establishing the conformity of the commissioned capacity (capacity, throughput) the indicators approved in the construction project of the construction site;

4) conducting control testing and testing of installed technological, engineering or other equipment and engineering systems;

5) in case of unsuitability of the construction site for operation, submission to the customer of the relevant reasoned conclusion.

9. The signing of the acceptance certificate for the construction site is carried out after the final inspection of the construction site and compliance with the requirements established by this chapter.

10. The operation of a construction site without an approved certificate of acceptance of the construction site is not allowed. It is allowed to operate industrial (production) facilities on the territory of special economic and industrial zones during commissioning. The products produced during commissioning that meet the requirements of standardization and safety are sold after the approval of the certificate of acceptance of the construction site into operation.

11. The basis for entering into the digital system of the legal cadastre identification and technical information of buildings, structures and (or) their components for newly created immovable property, registration of rights to immovable property is the approved act of acceptance of the construction site into operation.

12. Prior to the approval of the acceptance certificate for the construction site, the customer sends an executive geodetic survey of the actual position of engineering networks and (or) buildings (structures) to the state urban planning cadastre for registration in the automated digital system of the state urban planning cadastre in accordance with the rules for registration in the automated digital system of the state urban planning cadastre of urban projects, pre-design and design estimates, as well as architectural objects, urban planning and construction activities.
