1. The customer (owner, investor) independently carries out the acceptance of the construction object into operation of the construction objects of the third level of responsibility specified in paragraph 4 of Article 98 of this Code.

2. The norms of this Article may not be applied if the changes to the premises (separate parts of a construction facility) specified in paragraph 4 of Article 98 of this Code, as well as the construction and operation of the listed third-level construction facilities infringe on the rights of other citizens or contradict state, public and (or) private interests.

3. The provisions of this article also do not apply to construction:

1) construction projects financed by public investments or with their participation;

2) individual residential buildings.

4. The procedure for acceptance, as well as the form of the certificate of acceptance of a construction object into operation by the customer (owner, investor), are independently approved by the authorized body for architecture, urban planning and construction.

5. The act of acceptance of a construction object into operation by the customer (owner, investor) independently with the application of an executive geodetic survey of the actual position of engineering networks and (or) buildings (structures) is subject to mandatory registration by local executive bodies performing functions in the field of architecture and urban planning in the automated digital system of the state urban cadastre.

An executive geodetic survey is not required when the objects are handed over by the owner independently for the objects specified in the sub-paragraphs 4), 12), 14), 17), 18) and 20) of the first part of paragraph 4 of Article 98 of this Code.
