Article 135. The procedure for maintaining and accounting of acceptance certificates of a construction facility in operation of the Building Code of the Republic of Kazakhstan

1. The State Corporation "Government for Citizens", within one working day from the moment of receipt from the applicant of the approved act of acceptance of the construction object into operation, accompanied by the technical characteristics of the construction object and the executive geodetic survey of the actual position of engineering networks and (or) buildings (structures), declaration of conformity, conclusions on the quality of construction andinstallation works, compliance of the completed works with the approved construction project and compliance of the facility with fire safety requirements are sent simultaneously:

1) to the relevant local executive body performing functions in the field of architecture and urban planning, at the location of the construction site, an approved act of acceptance of the construction site into operation, accompanied by the technical characteristics of the construction site and the executive geodetic survey of the actual position of engineering networks and (or) buildings (structures);

2) to the state bodies carrying out architectural and construction control and supervision, at the location of the construction object, an approved act of acceptance of the construction object into operation, accompanied by the technical characteristics of the construction object, a declaration of conformity, conclusions on the quality of construction and installation work, compliance of the work performed with the approved construction project and compliance of the object with fire safety requirements.

2. Local executive bodies performing functions in the field of architecture and urban planning, before the expiration of one working day from the date of receipt of documents from the State Corporation "Government for Citizens", verify the customer's compliance with the procedures defined by the rules for the organization of development and passage of licensing procedures in the field of construction, and record the act of acceptance of the construction site into operation by automated digital system of the state urban planning cadastre.

Based on the results of the reconciliation, if a construction site is found to be inconsistent with the requirements of the rules for building organization and passing construction licensing procedures, the state architectural and Construction Control and supervision authorities and the Government for Citizens State Corporation will be informed in writing within one business day of receiving the documents from the Government for Citizens State Corporation.

If there is no discrepancy, the Government for Citizens State Corporation is informed in writing within one business day from the moment of receipt of the documents from the Government for Citizens State Corporation.

3. The state bodies carrying out architectural and construction control and supervision, before the expiration of one working day from the date of receipt of documents from the State Corporation "Government for Citizens", carry out a reconciliation for compliance by the customer with the norms and requirements established by the legislation of the Republic of Kazakhstan on architectural, urban planning and construction activities, including:

1) availability of approvals and compliance of the received documents with the approved forms and established requirements of the rules for the organization of construction and passage of licensing procedures in the field of construction;

2) the availability of confirmation by the central executive body responsible for the management and intersectoral coordination in the field of social protection of the population, ensuring access for low-mobility groups of the population;

3) connection to external utilities that ensure the normal operation of the construction site and accepted by the operating organizations;

4) compliance of apartments and non-residential premises located in multi-apartment residential buildings with noise insulation requirements;

5) availability of an executive geodetic survey of the actual position of underground engineering networks and (or) buildings (structures);

6) availability of a floor plan and (or) a construction site plan with an explication;

7) availability of a notice of the start of construction and installation work, including updated information on all changes during the construction period;

8) compliance with established duties by technical supervision;

9) compliance of technical and economic indicators with the approved construction project, which has passed a comprehensive non-departmental expert examination of construction projects;

10) the registration and registration of the executive geodetic survey in the automated digital system of the state urban cadastre.

If violations are detected, the Government for Citizens State Corporation is informed in writing within one business day from the moment of receipt of documents from the Government for Citizens State Corporation with a detailed description of the detected violation.

If there is sufficient data indicating a violation of the requirements of this Code and non-compliance with licensing procedures in the field of construction, the state architectural and construction control and supervision authorities apply measures to bring those who committed violations to justice, established by the laws of the Republic of Kazakhstan.

If there are no violations, the Government for Citizens State Corporation will be informed in writing about this within one working day from the moment of receiving the documents from the Government for Citizens State Corporation.

4. Responsibility for providing information within the time limits established by paragraphs 2 and 3 of this Article is assigned to officials of local executive bodies performing functions in the field of architecture and urban planning, as well as state architectural and construction control and supervision in accordance with the procedure established by the laws of the Republic of Kazakhstan.
