1. The operation of construction facilities must be carried out in accordance with their permitted use (purpose).

2. The operation of a constructed or reconstructed construction facility is allowed after the commissioning of this facility, except for the cases specified in paragraph 3 of this article.

3. If a construction permit is not required for the construction or reconstruction of construction facilities, the operation of such facilities is allowed after the completion of their construction or reconstruction.

4. In the case of major repairs of a construction facility, the operation of such construction facilities is allowed after the completion of their major repairs.

5. The operation of construction facilities, including the maintenance of highways, must be carried out in accordance with the requirements of technical regulations, regulatory legal acts of the Republic of Kazakhstan, as well as in accordance with the project documentation. If the construction and reconstruction of buildings and structures in accordance with this Code does not require the preparation of design documentation and/or the issuance of construction permits, the operation of such buildings and structures must be carried out in accordance with the requirements of technical regulations and regulatory legal acts of the Republic of Kazakhstan.

6. In order to ensure the safety of construction facilities during their operation, maintenance of construction facilities, operational control over the technical condition of construction facilities, and routine repairs of buildings and structures must be provided.

7. Operational control over the technical condition of construction facilities is carried out during the operation of such facilities by carrying out periodic inspections, control checks and (or) monitoring the condition of foundations, building structures, systems and networks of engineering support in order to assess the condition of structural and other characteristics of reliability and safety of construction facilities, systems and networks of engineering support and compliance of the specified characteristics with the requirements of regulatory legal acts of the Republic of Kazakhstan, state regulatory documents, project documentation, as well as in accordance with the executive documentation.

8. Maintenance of construction facilities, repair of buildings and structures are carried out in order to ensure the proper technical condition of such facilities. Proper technical condition of construction facilities refers to the maintenance of stability parameters, reliability of construction facilities, as well as the serviceability of building structures, systems and networks of engineering and technical support, and their elements in accordance with the requirements of regulatory legal acts of the Republic of Kazakhstan, state regulatory documents, and design documentation.

9. In cases defined by the legislation of the Republic of Kazakhstan, during the repair of buildings and structures, individual elements of building structures of such construction facilities (with the exception of elements of load-bearing building structures), elements of systems and networks of engineering and technical support of such construction facilities may be replaced and (or) restored.

10. Operational control over the technical condition of construction facilities is carried out by the person responsible for the operation of the construction facility.

11. The specifics of the operation of certain types of construction facilities may be established by the legislation of the Republic of Kazakhstan. The operation of multi-family residential buildings is carried out taking into account the requirements of the housing legislation of the Republic of Kazakhstan.

12. If the local executive body at the location of buildings and structures receives applications from individuals or legal entities on violation of the requirements of the legislation of the Republic of Kazakhstan on the operation of construction facilities, on the occurrence of emergency situations in construction facilities or the threat of destruction of construction facilities, local executive bodies inspect construction facilities in order to assess their technical condition and proper maintenance in in accordance with the requirements of the technical regulations, the regulatory legal acts of the Republic of Kazakhstan relate to the structural and other characteristics of reliability and safety of construction facilities, the requirements of the design documentation of these facilities, and send recommendations on measures to eliminate identified violations to those responsible for the operation of construction facilities. The procedure for conducting this inspection is established by the legislation of the Republic of Kazakhstan.

13. During the operation of construction facilities, state control and supervision are carried out in cases stipulated by the laws of the Republic of Kazakhstan.
