Article 142. Personal surety of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan
1. Personal surety consists in the acceptance by trustworthy persons of a written commitment that they vouch for the proper behavior of the suspect and the accused and their appearance at the summons of the body conducting the criminal process. The number of guarantors may not be less than two.
2. The choice of personal surety as a preventive measure is permissible only upon the written request of the surety and with the consent of the person in respect of whom the surety is being given.
3. The surety shall give a subscription on personal surety, in which he confirms that the essence of the suspicion of the person in respect of whom he is giving surety has been explained to him, the surety's responsibility, consisting in imposing a monetary penalty on him in case the suspect or accused commits actions for the prevention of which this measure of restraint is applied.
4. The surety has the right to withdraw from the surety at any time during the criminal proceedings. In this case, within forty-eight hours from the moment of refusal, another preventive measure must be chosen in respect of the suspect, the accused, taking into account the requirements of the first part of Article 136 of this Code.
5. If a suspect or accused commits acts for the prevention of which personal surety has been applied, a monetary penalty may be imposed on each surety by the court in accordance with the procedure provided for in Article 160 of this Code.
