Article 143. Supervision of the command of a military unit over a serviceman of the Criminal Procedure Code of the Republic of Kazakhstan Criminal Procedure Code of the Republic of Kazakhstan

     1. The supervision of the command of a military unit over a suspect or accused who is a serviceman consists in taking measures provided for by the charters of the Armed Forces, other troops and military formations of the Republic of Kazakhstan and capable of ensuring the proper behavior of this person and his appearance at the summons of the body conducting the criminal process.

     2. The command of the military unit is informed of the nature of the suspicion on which this preventive measure has been chosen. The command of the military unit notifies in writing the body that has chosen this measure of restraint about the establishment of surveillance.

     3. If the suspect or the accused commits actions for the prevention of which this measure of restraint was chosen, the command of the military unit is obliged to immediately inform the body that chose this measure of restraint.

     4. Persons guilty of non-fulfillment of the monitoring duties assigned to them shall bear disciplinary responsibility provided for by law.

     5. During the period of validity of this preventive measure, it is not allowed to involve the suspect or the accused in combat duty, combat or guard duty, service as part of a garrison detachment or a daily unit (unit).
