Article 440. Violation of the statutory rules of relations between military personnel in the absence of subordinate relations between them Criminal Code of the Republic of Kazakhstan

1. violation of the statutory rules of relations between military personnel in the absence of subordinate relations between them, manifested in beatings, minor harm to health or other use of force, or in connection with humiliation or humiliation of the dignity and dignity of the victim –

     punishable by a fine of up to one hundred and sixty monthly calculation indices, or correctional labor in the same amount, or imprisonment for a period of up to forty days.

     2. the same action performed several times –

     punishable by a fine of up to two hundred monthly calculation indices, or correctional labor in the same amount, or imprisonment for a period of up to fifty days.

     2-1. actions provided for in the first or second parts of this article, committed with moderate harm to health –

     punishable by a fine of up to five hundred monthly calculation indices, or correctional labor in the same amount, or restriction of freedom for a period of up to three years, or imprisonment for the same period.

     3. provided for in the first, second or parts 2-1 of this article:

     1) in relation to two or more persons;

     2) committed by a group of people or a group of people by prior collusion;

     3) using weapons or special tools;

     4) actions committed with serious harm to health –

     punishable by imprisonment for a period of four to eight years.

     4. actions provided for in the first, second, 2-1 or third parts of this article, committed by a criminal group or resulting in the death of a person or other serious consequences –

     sentenced to imprisonment for a period of eight to twelve years.
