Article 149. Subsurface use operations for hydrocarbons in the border areas of the Subsurface Code on Subsurface and Subsurface Use Republic of Kazakhstan
1. If, as a result of conducting subsurface use operations for hydrocarbons, a subsurface user discovers a deposit (a set of deposits) located within the territory of the Republic of Kazakhstan or the sea, part of which is also located on the territory or on the sea under the jurisdiction of another adjacent or opposing state, he is obliged to immediately notify the competent authority about this..
2. In the absence of relevant international agreements between the Republic of Kazakhstan and the state in whose bowels a part of the discovered deposit (aggregate of deposits) is located, the competent authority has the right to decide to suspend operations on subsurface use of hydrocarbons in the border area of the subsoil until an agreement is reached with such a state.
At the same time, the competent authority, within three working days from the date of the decision to suspend operations on subsurface use of hydrocarbons in the bordering subsurface area, notifies the subsurface user about it and within thirty calendar days initiates the development of an international agreement regulating the procedure and conditions for the joint development of a deposit located in the bordering subsurface area.
3. If the competent authority decides to suspend subsurface use operations for hydrocarbons in the bordering subsurface area, the contract is considered suspended until the competent authority issues a permit to resume suspended subsurface use operations.
