Article 186. Transfer of a registered statement or report of a criminal offense under the jurisdiction of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. Registered statements or reports of a criminal offense are subject to transfer under investigation when:

1) the criminal offense was committed outside the given district, capital, region, city of republican significance and for the pre-trial investigation it is necessary to conduct investigative actions at the place where the criminal offense was committed.;

     2) the investigation of a criminal case belongs to the exclusive jurisdiction of another body of criminal prosecution.

     2. Applications and reports with available materials are sent by the head of the criminal prosecution body through the prosecutor.

     3. The rules of the first part of this article do not apply to cases of receipt of statements, reports of criminal offenses, which require urgent investigative actions. In such cases, the collected materials are transferred to the prosecutor for transfer under investigation within five days from the moment of registration of the application, message.

     4. Statements and messages are transferred under investigation along with objects and documents found during the inspection of the scene, area or premises, or provided by organizations, officials or citizens.

     5. Only statements by victims (private prosecutors) about criminal offenses prosecuted under private prosecution are subject to jurisdiction.
