Article 21. Rights and duties of officials of the State Forest Inspectorate of the Republic of Kazakhstan of the Forest Code of the Republic of Kazakhstan

1. Officials of the State Forest Inspection of the Republic of Kazakhstan have the right:
IZPI's note! Subparagraph 1) is amended by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).
1) to inspect all types of work and measures for the protection, protection, reproduction of forests and forest management, as well as to monitor compliance with the procedure established by the legislation of the Republic of Kazakhstan when carrying out work in the state forest fund that is not related to forestry and forest management, and to give written instructions to individuals and legal entities to eliminate the identified deficiencies;
2) excluded by the Law of the Republic of Kazakhstan dated 25.01.2012 No. 548-IV (effective after ten calendar days after its first official publication);
3) draw up protocols on administrative offenses in the field of forest legislation of the Republic of Kazakhstan, legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife and specially protected natural territories;
3-1) issue instructions on the elimination of violations of this Code and resolutions of the Government of the Republic of Kazakhstan in the field of protection, protection, use of forest resources, reproduction of forests and afforestation;
3-2) to make rulings:
on bringing the perpetrators to administrative responsibility in case of violation of the forest legislation of the Republic of Kazakhstan;

on the seizure of extracted forest resources, means of transport, and tools for their extraction for temporary storage until a court decision is rendered;
3-3) draw up a report on the results of the audit;
4) suspend, restrict, terminate the right of forest use in accordance with the laws of the Republic of Kazakhstan;
5) file claims against individuals and legal entities for compensation for damage caused to the state forest fund by violation of the forest legislation of the Republic of Kazakhstan, legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife and specially protected natural territories in accordance with the procedure established by the legislation of the Republic of Kazakhstan.;
6) make representations to the heads of relevant state bodies on bringing to justice officials who have violated the forest legislation of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife and specially protected natural territories, on violations involving criminal liability, to report to law enforcement agencies for making procedural decisions;

7) to seize illegally obtained forest resources, vehicles and other objects that were tools for committing an offense, and to ensure their safety until a court decision is rendered.
2. Officials of the State Forest Inspectorate of the Republic of Kazakhstan are obliged to exercise control and supervision over:
1) the quality of the implementation of forestry measures and their compliance with forest management projects in the areas of the state forest fund;
1-1) quantitative and qualitative changes in the forest fund, the sanitary condition of forests, and the forest pathology situation in forests;
2) the procedure for the transfer of forest resources to forest management in the areas of the state forest fund and compliance with long-term and short-term forest management agreements;
3) meeting the requirements of fire safety in forests, measures to prevent forest fires, to ensure their timely detection and elimination, as well as the accuracy of accounting for harem areas and determining the damage caused by fires to the state forest fund, the timeliness of measures taken to eliminate the consequences of forest fires;
4) the implementation of measures to protect forests from pests and diseases of the forest, the timeliness of measures taken to prevent the occurrence and spread, the accuracy of accounting and forecasting foci of pests and diseases of the forest, the weakening and death of plantations from adverse effects of natural, anthropogenic and man-made nature;
5) compliance with the rules for the release of wood on the root and logging, other rules of forest management in the areas of the state forest fund;
5-1) by allotment of cutting areas;
6) observance of protection regimes in forests of specially protected natural territories;
7) observance of forest-seed zoning, harvesting, processing, storage and use of forest seeds, and management of nursery farming on the sites of the state forest fund;
8) the use of forest fund lands in accordance with their intended purpose and the protection of these lands;

9) compliance with the procedure for using the state forest fund during construction work, mining, laying communications and performing other work not related to forestry and forest management;
10) compliance with other requirements of the forest legislation of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of wildlife and specially protected natural territories.
3. Officials of the State Forest Inspectorate of the Republic of Kazakhstan are allowed to keep, carry and use service weapons in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
4. Officials of the State Forest Inspectorate of the Republic of Kazakhstan, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, are provided with uniforms with insignia (without shoulder straps) and service weapons.
The list of positions of officials entitled to wear uniforms with insignia (without shoulder straps), samples of uniforms with insignia (without shoulder straps), and the order of wearing are determined by the authorized body.
5. Officials of the State Forest Inspectorate of the Republic of Kazakhstan are subject to legal and social protection in accordance with the legislation of the Republic of Kazakhstan.
