Article 178. Rights and duties of officials exercising state environmental control of the Environmental Code of the Republic of Kazakhstan
1. Officials exercising state environmental control have the right to:
1) to carry out preventive control with a visit to the subject (facility) or inspection, if there is an appropriate legal basis, enter the territory and premises of the inspected facility, including with measuring instruments and sampling equipment, and, if necessary, with the involvement of specialists, consultants and experts in accordance with the legislation of the Republic of Kazakhstan, carry out the necessary take measurements, take samples (including samples of goods and materials) and analyze them;
2) request and receive from the inspected subjects (objects) the results of laboratory tests of samples and other materials necessary to determine the extent of anthropogenic impact on the environment.;
3) file lawsuits with the court for the restriction, suspension and prohibition of the activities of the subject of state environmental control carried out in violation of the requirements of the environmental legislation of the Republic of Kazakhstan;
4) identify the facts of causing environmental damage and participate in determining measures to eliminate it in accordance with the requirements of this Code;
5) apply to the prosecutor's office and other law enforcement agencies for assistance in preventing or suppressing the actions of violators of the requirements of the environmental legislation of the Republic of Kazakhstan;
6) take measures provided for by the laws of the Republic of Kazakhstan to revoke, revoke and suspend the validity of permits, conclusions, licenses and other permits of individuals and legal entities in connection with violation of the requirements of the environmental legislation of the Republic of Kazakhstan.
2. Officials exercising state environmental control, in cases provided for by the legislation of the Republic of Kazakhstan, have the right to store, carry and use special means (specialized means of communication, photographic, video equipment, measuring instruments).
3. Officials exercising state environmental control are required to interact with other government agencies, as well as individuals and (or) legal entities, on issues related to ensuring compliance with the requirements of the environmental legislation of the Republic of Kazakhstan.
4. If it is necessary to prevent violations, the exercise of the powers of officials exercising state environmental control may be carried out outside of hours (at night, weekends or holidays).
