Article 21. Unified Telecommunications Network of the Republic of Kazakhstan Chapter 3. Communication networks of the Law on Communications
1. The Unified Telecommunications Network of the Republic of Kazakhstan is a telecommunications network located on the territory of the Republic of Kazakhstan and consisting of telecommunications networks of the following categories:
1) public telecommunication networks;
2) departmental telecommunications networks;
3) Dedicated telecommunication networks;
4) special purpose telecommunication networks;
5) corporate and other information transmission networks through electromagnetic signals.
2. For the networks that make up the unified telecommunications network of the Republic of Kazakhstan, with the exception of presidential communications networks, the national security authorities determine the functioning of the centralized telecommunications network management system of the Republic of Kazakhstan, which includes:
organization, registration and operation of international junction points;
a set of organizational and technical measures, the formation of control parameters;
requirements for the means of communication used and their management, ensuring information security on communication networks, commissioning of communication networks and monitoring of execution;
provision by long-distance and international communication operators of lines and communication channels necessary to ensure the functioning of the centralized telecommunications network management system of the Republic of Kazakhstan.
3. Telecom operators of all categories of networks are required to have a communications network management center in the territory of the Republic of Kazakhstan.
Employees of telecom operators, whose functional responsibilities include the operation and maintenance of operational search and counterintelligence measures, as well as the maintenance of systems for the collection and storage of official information, must be citizens of the Republic of Kazakhstan. It is prohibited for telecom operators to transfer control of their own communication networks to other persons in any form.
When creating telecommunications networks, telecom operators ensure that the telecommunications equipment of communication networks complies technologically with national standards that establish requirements for conducting operational search and counterintelligence activities.

Telecom operators and owners of telecommunications networks are prohibited from passing unauthorized traffic (fraud) in the local telecommunications network, long-distance, international and cellular communications
4. Public telecommunications networks are a complex of interconnected telecommunications networks designed to provide telecommunications services to all users in the territory of the Republic of Kazakhstan.
Public telecommunication networks are divided into telecommunication networks, defined by:
1) geographically within the serviced territory and numbering resource (local telecommunications networks);
2) non-geographically unrelated to a geographically defined territory within the Republic of Kazakhstan and a numbering resource;
3) excluded by the Law of the Republic of Kazakhstan dated December 28, 2017 No. 128-VI (effective ten calendar days after the date of its first official publication).
Public telecommunication networks interact with public telecommunication networks of foreign countries.
5. Departmental telecommunications networks are designed to ensure the implementation of managerial and organizational goals of state bodies and local governments in accordance with their powers, as well as to ensure the production and management goals of state-owned enterprises and institutions.
Departmental telecommunications networks interact with each other through a unified transport environment of government agencies, including through the use of government encryption tools and other information security tools used in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
5-1. When providing communication services to government agencies with the provision of lines and communication channels that are not part of the unified transport environment of government agencies and transmit information using radio-electronic means, telecom operators provide, free of charge, the use of information security tools on these lines and communication channels in accordance with the procedure determined by the authorized body.
6. Dedicated telecommunications networks are an independent category of telecommunications networks and are designed to provide telecommunications (electrical communication) services to a limited number of users and:
1) they may interact with each other, but they are not connected to the public telecommunications networks of the Republic of Kazakhstan or any other networks connected to public telecommunications networks, as well as to public telecommunications (electric communications) networks of foreign states;
2) may be connected to public telecommunication networks with transfer to the category of public telecommunication networks if they comply with the requirements governing the functioning of public telecommunication networks. In this case, the non-geographic code assigned earlier to this dedicated network is withdrawn.;
3) the provision of communication services by the operators of these telecommunications networks is carried out on the basis of licenses.
The technologies and means of communication used to organize dedicated networks, as well as the principles of construction and numbering system are established by the owners of these networks. Numbering (non-geographical code) is not allocated from the national resource for this category of networks.
7. Special-purpose telecommunications networks are designed to meet the needs of authorized government agencies, the State Security Service, military authorities, national security and internal affairs of the Republic of Kazakhstan, which can be used as the basis for public telecommunications networks.
Special purpose telecommunication networks may not be used for the provision of paid communication services, unless otherwise provided by the laws of the Republic of Kazakhstan.
The procedure for building, managing, using, distributing numbering, organizational and technical support for operation, information security, traffic access, conditions for interaction and commissioning (decommissioning) of special-purpose telecommunications networks is determined by the heads of authorized state bodies, the State Security Service, military administration bodies, national security and internal affairs of the Republic of Kazakhstan, for to meet the needs of which these networks are intended.
8. Corporate telecommunications networks are designed to ensure the implementation of management and internal business objectives of legal entities.
Corporate telecommunications networks can:
1) have connection to public telecommunications networks as a corporate client through an institutional switching station within the administrative territory or at the level of a transit hub of the international switching center of the Republic of Kazakhstan, if they combine network sections distributed across different administrative territories with the allocation of an appropriate numbering resource;
2) be used for the provision of paid communication services (if there are no networks of public telecommunications network operators in their area of operation), subject to obtaining a business license in accordance with Article 17 of this Law.
9. Television and radio broadcasting networks are an integral part of a unified telecommunications network and constitute a single production and technological complex of terrestrial and satellite broadcasting systems used for the distribution and broadcasting of television and radio programs on the territory of the Republic of Kazakhstan and foreign countries. Terrestrial systems include radio relay and cable communication lines, radio transmitters of various capacities, and other means for broadcasting government and commercial programs. Satellite systems include orbiting communications satellites belonging to international satellite organizations, individual States, and ground-based transmitting and receiving stations.

The Law of the Republic of Kazakhstan dated July 5, 2004 No. 567.
This Law establishes the legal basis for activities in the field of communications in the territory of the Republic of Kazakhstan, defines the powers of state bodies to regulate these activities, the rights and obligations of individuals and legal entities providing or using communications services.
