Article 214. Illegal business The Criminal Code of the Republic of Kazakhstan, the Criminal Code of the Republic of Kazakhstan
1. Carrying out entrepreneurial activities without registration or a license required for such activities, or in violation of the legislation of the Republic of Kazakhstan on permits and notifications, as well as engaging in prohibited types of entrepreneurial activities, if these acts have caused major damage to a citizen, organization or state, or involve the extraction of large-scale income or the production, storage, transportation or sale of excisable goods in significant size, –
are punishable by a fine in the amount of up to two thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to six hundred hours, or restriction of liberty for up to two years, or imprisonment for the same period, with or without confiscation of property.
2. The same deeds:
1) committed by a criminal group;
2) associated with the extraction of income on a particularly large scale;
3) committed repeatedly, –
are punishable by a fine in the amount of up to five thousand monthly calculation indices, or correctional labor in the same amount, or community service for up to one thousand two hundred hours, or restriction of liberty for up to five years, or imprisonment for the same period, with confiscation of property.
Note. A person who has committed an act provided for in the first part of this article for the first time shall be released from criminal liability in case of voluntary compensation for damage.
By the Normative Resolution of the Constitutional Court of the Republic of Kazakhstan dated 03.10.2023 No. 31-NP, the note of Article 214 of the Criminal Code of the Republic of Kazakhstan is recognized as corresponding to the Constitution of the Republic of Kazakhstan.
