Article 233. Resolution on conducting a secret investigative action of the CPC of the Republic of Kazakhstan Code of Criminal Procedure of the Republic of Kazakhstan
1. The authorized official of the body charged with conducting a secret investigative action shall issue a resolution that must comply with the requirements established by Article 198 of this Code.
The resolution must contain:
1) the place and time of its compilation;
2) the position, surname and initials, personal signature of the person who issued the resolution;
3) excluded by the Law of the Republic of Kazakhstan dated December 21, 2017 No. 118-VI (effective from 03/01/2018);
4) the number of the criminal case in which it is supposed to carry out secret investigative actions;
5) the articles of this Code on the basis of which the resolution was issued;
6) a brief description of the plot of the criminal case;
7) justification of the need for a secret investigative action;
8) information about the person, place or object in respect of which it is planned to carry out a secret investigative action;
9) the duration of the secret investigative action;
10) information about the body charged with conducting a secret investigative action.
2. In order to exclude the decryption of the object in respect of which a secret investigative action is being carried out, it is allowed in the resolution to indicate a pseudonym, a conditional name instead of the real data. An appropriate resolution is issued on data modification in compliance with confidentiality requirements, which is coordinated with the prosecutor.
