1. A non-profit organization may establish branches and open representative offices in the territory of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan.

Public and religious associations and institutions may establish their own structural units in accordance with the legislative acts on these organizations.

2. A branch of a non-profit organization is a separate subdivision of a non-profit organization located outside its location and performing all or part of its functions, including the functions of a representative office.

3. A representative office of a non-profit organization is a separate subdivision of a non-profit organization located outside its location and performing protection and representation of the interests of a non-profit organization, making transactions and other legal actions on its behalf.

4. Branches and representative offices are not legal entities. They are endowed with the property of the non-profit organization that created them and act on the basis of the regulations approved by it. The property of a branch or representative office is accounted for on a separate balance sheet and on the balance sheet of the non-profit organization that created them.

5. The heads of branches and representative offices of non-profit organizations (with the exception of public and religious associations) are appointed by the authorized body of the non-profit organization and act on the basis of its power of attorney.

The heads of structural divisions (branches and representative offices) of public associations are elected in accordance with the procedure provided for by the charter of the public association and the regulations on its branch or representative office.

The heads of structural divisions (branches and representative offices) of religious associations are elected or appointed in accordance with the procedure provided for by the charter of a religious association and the regulations on its branch or representative office.

6. The branch and representative office carry out activities on behalf of the non-profit organization that created them. The responsibility for the activities of its branch or representative office is borne by the non-profit organization that created them.

6-1. The name of the branch and representative office of a non-profit organization must contain an indication of the name of the non-profit organization that created them.

7. Branches and representative offices of a non-profit organization are subject to registration, and in case of name change, re-registration.

The procedure and terms of registration (re-registration) are determined by the legislation of the Republic of Kazakhstan on state registration of legal entities and registration of branches and representative offices.
