Article 246. Secret control of postal and other items of the CPC RK Criminal Procedure Code of the Republic of Kazakhstan

     1. If there are sufficient grounds to believe that letters, telegrams, radiograms, parcels, parcels, and other mail items may contain information, documents, and items relevant to the case, secret control may be exercised over them.

     2. Recognizing the need for secret control of postal and other items, the investigator and the inquirer make a reasoned decision.

     The resolution must specify: the name of the communication institution responsible for the detention of postal and telegraphic items, the surname, first name, patronymic (if any) of the persons whose postal and telegraphic items are subject to secret control, their address, the type of postal and telegraphic items that are subject to secret control, the period for which which it is imposed on.

     The said resolution is submitted to the investigating judge and, if sanctioned, is sent by the investigator or the inquirer to postal institutions or persons providing services for the delivery of shipments for execution.

     3. Postal institutions or persons providing services for the delivery of items shall immediately inform the investigator or inquirer about the presence of postal and other items subject to control in their possession.

     The investigator, the inquirer, within twenty-four hours from the moment of receiving the notification, in the presence, if necessary, of an authorized employee of the postal institution or a person providing services for the delivery of shipments, inspect and (or) get acquainted with the contents of the shipment, make decisions on the further delivery of this shipment with or without recording its contents.

     4. In each case of inspection and (or) familiarization with postal and other items by an investigator, an inquirer in compliance with the requirements According to Article 199 of this Code, a protocol is drawn up, which reflects the data of the persons involved in the production of the event, the name and type of postal and other items that have been inspected and (or) familiarized, information about the further delivery of the shipment with or without recording its contents.

     5. If necessary, to participate in the inspection and seizure of postal and telegraphic items, the investigator or inquirer has the right to call an appropriate specialist, as well as an interpreter.

     6. The secret control of postal and other items is canceled by the investigator (inquirer) with the approval of the investigating judge, when there is no need for this measure, but in any case not later than the end of the investigation, which is notified within three days to the postal institution or the person providing services for the delivery of items.
