Article 27. The procedure for awarding special ranks The Law on Special State Bodies of the Republic of Kazakhstan

1. Special ranks are assigned to employees individually. A special rank can be the first or the next.

     2. Special ranks are assigned to employees:

     1) senior officers – by the President of the Republic of Kazakhstan in accordance with the procedure determined by the President of the Republic of Kazakhstan;

     2) Colonel – the first head of a special government agency;

     3) other special ranks – by officials designated by the first heads of special state bodies in accordance with the nomenclature of positions.

     3. The first special ranks are considered to be:

     1) for officers – Lieutenant;

     2) for sergeants – junior sergeant;

     3) for the rank and file – private.

     4. The special rank of "Lieutenant" is awarded:

     1) an employee who does not have a special officer rank, who has graduated from a military, special educational institution or educational organization of a foreign state in the direction of special state bodies for educational programs of higher education or who has completed training in educational programs of additional education with a period of study of at least six months;

     2) an employee who does not have a special officer rank, has a higher professional education related to the relevant specialty, and has entered the service under a contract for a position for which the staff provides for the rank of officer, when appointed to the appropriate position.

     5. The first special officer rank is awarded by the first head of the special government agency in which the employee serves.

     6. The special rank of "junior sergeant" is awarded to an employee who is appointed to a position for which a special rank of "junior sergeant" or higher is provided. Subsequent special ranks of sergeants are awarded to employees who have the necessary level of training and are appointed to the appropriate positions, but not earlier than twelve months later.

     7. The special rank of "junior sergeant" is awarded to a citizen who does not have a military rank, who has a post-secondary or higher education, upon entering the service under a contract for a position for which the staff provides for the rank of sergeant, upon appointment to the appropriate position.

     8. The special rank of "private" is awarded to citizens who do not have a special rank.:

     1) when entering the service under a contract for enlisted personnel positions;

     2) upon enrollment in a military or special educational institution or referral to an educational organization of a foreign state.

     9. A citizen enlisted from the reserve or accepted as a transfer from the Armed Forces, other troops and military formations, is awarded a special rank in the order of recertification not lower than his military rank.

     Persons who previously served in special government or law enforcement agencies, civil protection agencies, enlisted from the reserve or accepted as a transfer from other special government agencies and have a special rank, class rank or qualification class, are awarded a special rank by way of recertification. The procedure for recertification and assignment of a special title is determined by the first head of a special government agency.

     The special military rank, class rank or qualification class of the highest commanding or officer staff of a person appointed to a special state body shall be recognized as corresponding to an equivalent special rank indicating affiliation to the body in which he serves, subject to the provisions of subitems 5) of paragraphs 1 and 2 of Article 26 of this Law.

     The length of service in the previous special, military rank, class rank or qualification class is counted towards the length of service for awarding the next special rank.

     Employees and military personnel who have been reassigned within the same special government agency are not subject to recertification.

     9-1. Employees who previously held political public positions and were appointed to positions not lower than deputy first heads of structural divisions and departments of a special state body shall be awarded a special title provided by the staff for their position, without applying the requirements of this Law, except in cases provided for in Article 27-1 of this Law.

     10. Another special rank is awarded to an employee after the expiration of the period of service in the previous special rank, if he holds a full-time position or is serving in a non-full-time position in accordance with subparagraphs 5) and 6) of paragraph 4 of Article 33 of this Law, for which an equal or higher special rank is provided.

     11. If an employee has not received a disciplinary penalty, he cannot be presented for the assignment of another special title.

     12. Excluded by the Law of the Republic of Kazakhstan dated 13.06.2017 No. 69-VI (effective ten calendar days after the date of its first official publication).

     13. The term of service in special ranks is calculated from the date of awarding the special rank.

     14. Special ranks may be awarded to staff members who have received appropriate training when appointed to non-commissioned officer positions.

     15. The next special rank is awarded after the expiration of the established period of service in the current special rank and if the assigned rank corresponds to the special rank in the position held by an employee studying at a military, special educational institution, educational organization of the Republic of Kazakhstan and (or) a foreign country within the framework of the state program for the training of civil servants.

     16. Employees who perform their official duties in an exemplary manner, who have shown high professionalism and diligence while serving or performing other duties of the service, may be awarded another special rank ahead of schedule, but not higher than the special rank provided for in their positions.

     An early special rank is awarded upon the expiration of at least half of the established period of service in a special rank, but not more than once during the period of service in special ranks of junior and senior officers, respectively.

     17. An employee who has achieved high performance in service, combat training, strengthening service discipline, mastering complex equipment, or performing exemplary duties in a designated area related to solving the tasks of a special government agency may be awarded another special rank up to lieutenant colonel, and officers of the scientific and pedagogical staff with an academic degree up to and including colonel - for one year. a step above the special rank prescribed by the position held.

     Another special rank one step higher than the special rank provided for by the position is awarded no more than once during the period of service and after at least two established terms of service in a special rank.

     18. Excluded by the Law of the Republic of Kazakhstan dated December 23, 2023 No. 51-VIII (effective ten calendar days after the date of its first official publication).

     19. A citizen (liable for military service) deprived of the special rank of officer or non-commissioned officer, simultaneously with the transfer of enlisted personnel to the military register, is awarded the military rank of "private" by the head of the local military administration body of the region (city of republican significance and the capital).

 

The Law of the Republic of Kazakhstan dated February 13, 2012 No. 552-IV.

This Law defines the status of special state bodies of the Republic of Kazakhstan (hereinafter referred to as special state bodies), regulates public relations related to admission to service in special state bodies, its passage and termination, and also defines the legal status, financial support and social protection of employees of special state bodies.
