Article 28. Competence of akimats of regions, cities of republican significance and the capital in architectural, urban planning and construction activities of the Building Code of the Republic of Kazakhstan

1. The competence of regional akimats includes:

1) coordination of activities related to the implementation of a comprehensive urban planning scheme for the territories of the region, districts, and general plans of settlements in the territory of the region approved in accordance with the established procedure;

2) implementation of state policy in the field of architecture, urban planning and construction, development of the production base of the construction industry;

3) submitting to the regional maslikhat for approval a draft general plan for a city of regional significance with an estimated population of over one hundred thousand inhabitants for subsequent submission to the Government of the Republic of Kazakhstan for approval;

4) organization of the development and submission to the Government of the Republic of Kazakhstan for approval of master plans of cities of regional significance with an estimated population of over one hundred thousand inhabitants, agreed with the regional maslikhat;

5) organization of the development and submission to the regional maslikhat for approval of comprehensive urban planning schemes for the territories of oblasts, districts, as well as draft general plans for the development of cities of regional significance with an estimated population of up to one hundred thousand inhabitants and their adjustments, agreed with the maslikhats of cities of regional significance with an estimated population of up to one hundred thousand inhabitants and passed a comprehensive urban planning examination;

6) coordination of projects of interregional schemes of territorial development of territories of two or more regions (or their parts), agglomerations;

7) submission to the regional maslikhat for approval of the rules for landscaping and engineering support of territories, as well as the rules for the preservation and maintenance of housing stock, other civil housing construction facilities, and engineering communications;

8) submission to the regional maslikhat for approval of the rules for the creation, maintenance and protection of green spaces not included in the forest fund of the Republic of Kazakhstan within the boundaries of the settlements of the region;

9) coordination of draft general plans of cities of republican significance, the capital in terms of their development at the expense of the territory of the region, reserve territories, suburban areas, as well as other territories attributed to their zone of influence;

10) coordination of draft general plans of cities of regional significance with an estimated population of over one hundred thousand inhabitants;

11) informing the public about the planned development of the territory or other urban planning changes;

12) control and implementation of urban development projects that have passed a comprehensive urban planning examination;

13) making decisions on the development of the territory, expansion, technical re-equipment, modernization, reconstruction (redevelopment, re-equipment, redevelopment), restoration and major repairs of construction sites, engineering and transport communications, as well as on the engineering preparation of the territory, landscaping and landscaping, conservation of unfinished construction sites, carrying out a complex of works on the postutilization of construction sites of the regional values;

14) record keeping and registration of acts on demolition of construction sites of regional significance;

15) keeping records of acceptance certificates for construction projects with mandatory consideration of access to low-mobility groups of the population;

16) assistance to the work of state bodies carrying out state architectural and construction control and supervision in the territory of the region;

17) entering information and (or) information for filling in the automated digital system of the state urban planning cadastre, as well as its use in the provision of public services;

18) submission to the authorized body for architecture, urban planning and construction of monthly reports on allotments and changes in the purpose of land plots;

19) monitoring of construction sites and complexes under construction (planned for construction) in accordance with the procedure determined by the authorized body for architecture, urban planning and construction;

20) coordination with national accredited sports federations of technical specifications and technical specifications for the design of sports facilities designed for international and national competitions;

21) implementation of state architectural and construction control and supervision, application of administrative measures established by the Code of the Republic of Kazakhstan on Administrative Offenses to violators of architectural and urban planning discipline at construction sites;

22) licensing in the field of architectural, urban planning and construction activities;

23) making decisions on the application of measures provided for by the laws of the Republic of Kazakhstan to violators in connection with violations and deviations from the norms of the legislation of the Republic of Kazakhstan, state regulatory documents, conditions and restrictions established in the field of architectural, urban planning and construction activities;

24) organization and supervision of the quality of project documentation;

25) review and approval of the pre-project documentation and the construction project, financed from the local budget, as well as the republican budget allocated to finance the local budget investment project;

26) accreditation of project management organizations in the field of architecture, urban planning and construction;

27) coordination of the boundaries of the territories of the forbidden zone and the forbidden area at the arsenals, bases and warehouses of the Armed Forces of the Republic of Kazakhstan, other troops and military formations;

28) submitting a draft master plan for a settlement located in a suburban area for approval by the akimat of the capital or a city of republican significance;

29) submitting qualification requirements for chief architects of the region and state construction inspectors for approval by the authorized body for architecture, Urban Planning and construction;

30) development and submission of a housing renovation program to the regional maslikhat for approval;

31) ensuring the supply and (or) modernization of engineering, communication and social infrastructures to renovation facilities in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

32) the implementation of interaction and cooperation with government agencies on issues related to their competence;

33) exercising other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan in the interests of local government.

2. The competence of akimats of cities of republican significance and the capital includes:

1) implementation of state policy in the field of architecture, urban planning and construction, development of the production base of the construction industry;

2) implementation of the city's master plan;

3) organization of the development and submission to the maslikhat for approval of a draft general plan of the city, a draft for the establishment and modification of the city limits and the boundaries of the suburban area, as well as the boundaries of the city districts;

4) submitting drafts of the general plan of the city for approval to the Government of the Republic of Kazakhstan;

5) submission for approval to the Maslikhat of the city rules of landscaping and engineering support of the subordinate territory;

6) submission to the city maslikhat for approval of the rules for the creation, maintenance and protection of green spaces not included in the forest fund of the Republic of Kazakhstan within the boundaries of the city;

7) submitting proposals to the Maslikhat on establishing rules for the preservation and maintenance of housing stock, other civil housing construction facilities, and engineering communications;

8) informing the public about the planned development of the territory or other urban planning changes;

9) approval and implementation of the detailed planning project being developed for the development of the approved general plan of the city;

10) making a decision on the development of the territory, expansion, technical re-equipment, modernization, reconstruction (redevelopment, re-equipment, repurposing), restoration and overhaul of construction facilities, engineering and transport communications, as well as on the engineering preparation of the territory, landscaping and landscaping, conservation of unfinished construction sites, carrying out a complex of works on the postutilization of construction sites with taking into account the vulnerability to natural disasters (floods, earthquakes, mudslides, landslides and avalanches);

11) record keeping and registration of acts on demolition of construction sites of urban importance;

12) keeping records of acceptance certificates for construction projects with mandatory consideration of access to low-mobility groups of the population;

13) assistance to the work of state bodies of state architectural and construction control and supervision;

14) organization of the preservation of housing stock, communications, historical and cultural monuments and control over their maintenance (use, operation);

15) entering information and (or) information for filling in the automated digital system of the state urban planning cadastre, as well as its use in the provision of public services;

16) maintenance and updating of the duty topographic plan of cities of republican significance, the capital in the automated digital system of the state urban cadastre for monitoring the development of territories;

17) monitoring of construction sites and complexes under construction (planned for construction) in accordance with the procedure determined by the authorized body for architecture, urban planning and construction;

18) coordination with national accredited sports federations of technical specifications and technical specifications for the design of sports facilities designed for international and national competitions;

19) implementation of state architectural and construction control and supervision, application of administrative measures established by the Code of the Republic of Kazakhstan on Administrative Offenses to violators of architectural and urban planning discipline at construction sites;

20) licensing in the field of architectural, urban planning and construction activities;

21) making a decision on the application of measures provided for by the laws of the Republic of Kazakhstan to violators in connection with violations and deviations from the norms of the legislation of the Republic of Kazakhstan, state regulatory documents, conditions and restrictions established in the field of architectural, urban planning and construction activities;

determining the projected population of a locality;

ensuring employment of the population;

providing the population with sources of drinking water and electric energy;

29) submitting for approval to the authorized body for architecture, urban planning and construction qualification requirements for chief architects and state construction inspectors of cities of republican significance and the capital;

30) development and submission of a housing renovation program to the city maslikhat for approval;

32) development and approval of the design code of cities of national importance and the capital;

33) approval of the rules for the administration of the design code of the city of republican significance and the capital;

34) provision of land plots for individual housing construction in accordance with the established procedure in the territories defined in accordance with approved urban development projects;

35) informing citizens about the rules for the construction and operation of individual residential buildings, other buildings and the use of land;

36) the implementation of interaction and cooperation with government agencies on issues related to their competence;

37) determination of the possibility (impossibility) of granting the right to a land plot in cities of republican significance and the capital in accordance with Article 44-2 of the Land Code of the Republic of Kazakhstan;

38) issuing an opinion in the form of a reasoned refusal on the impossibility of granting the right to a land plot in cities of republican significance and the capital in accordance with Article 44-2 of the Land Code of the Republic of Kazakhstan;

39) development and submission for approval to the authorized body for architecture, urban planning and construction of rules for the formation of the architectural appearance and urban planning of the city in accordance with the laws of the Republic of Kazakhstan;

40) exercising other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan in the interests of local government.
