Article 31. Declaration of a citizen as deceased by the Civil Code of the Republic of Kazakhstan

     1. Upon the application of interested persons, a citizen may be declared dead by a court if there has been no information about him in his place of residence for three years, and if he has been missing under circumstances threatening death or giving grounds to assume his death from an accident for six months.

     2. A serviceman or other person who has gone missing in connection with military operations may be declared dead no earlier than two years after the end of hostilities.

     3. The date of death of a person declared deceased is considered to be the date of entry into force of a court decision declaring him dead. In cases where a person who has gone missing has been declared dead under circumstances threatening death or giving grounds to assume his death from an accident, the court may recognize the day of death of this person as the day of his alleged death.

     4. On the basis of a court decision that has entered into legal force declaring a person dead, an entry on his death is made in the books of civil status records. The consequences of recording are the same as recording an actual death.
