Article 15. Termination of marriage (matrimony) as a result of the death of one of the spouses, the declaration of his death by the court or the recognition of the missing Code on Marriage (Matrimony) and Family of the Republic of Kazakhstan
1. Marriage (matrimony) is terminated as a result of the death of one of the spouses, as well as the declaration of his death by the court or recognition as missing.
2. In the event of the appearance of a spouse declared dead by the court or recognized by the court as missing, and the cancellation of the relevant court decisions, the marriage (matrimony) may be restored by the registering authority upon a joint application by the spouses.
3. Marriage (matrimony) cannot be restored if the other spouse has entered into a new marriage (matrimony), except in cases when at the time of the marriage (matrimony) the parties (or one of the parties) knew that the spouse, recognized as missing or declared dead, is alive.
